Georgia Election Subversion Case: Judge Delays Ruling in Willis Misconduct Hearing

Following an intense evidentiary hearing in the case aimed at disqualifying Fulton County District Attorney Fani Willis from the Georgia election subversion proceedings, Judge Scott McAfee announced that he would not issue any rulings the following day. The hearing, which took place on Thursday, saw McAfee express his intention to consider all aspects of the case before making any decisions.

 

"I'm not ruling on any of this tomorrow," McAfee stated emphatically at the close of the hearing. "This is something that's going to be taken under advisement on all aspects." He further suggested the possibility of scheduling final arguments from the involved parties at a later date.

 

The proceedings focused heavily on the testimony of Willis and her top prosecutor, Nathan Wade, regarding their relationships and financial transactions, particularly those occurring during vacations together. While Willis and Wade both testified on Thursday, the district attorney's examination will continue on Friday at 9 a.m. ET, beginning with cross-examination by District Attorney lawyer Anna Cross.

 

Defense attorney Ashleigh Merchant, leading the effort to remove Willis from the case, indicated plans to call two additional witnesses following Willis's testimony. Cross, on the other hand, informed the court of her intention to present three to four witnesses the next day, estimating that their testimony would span four to five hours.

 

With tensions high and legal maneuvers underway, the outcome of this hearing holds significant implications for the Georgia election subversion case, and McAfee's decision to postpone any rulings underscores the complexity and gravity of the matter at hand.

The judge says he thinks Bradley’s understanding of privilege could be too broad.

 

Abbate, from the district attorney’s office, says Bradley has already told the court that he has no independent knowledge about the information Merchant seeks.

 

With the issue in dispute, Bradley’s testimony has been paused while the court hears from a friend of Willis, Robin Yeartie, who is testifying via Zoom.

Wade said that Willis paid him many thousands of dollars in cash as reimbursement for romantic trips they took together that he put on his credit card. But he said repeatedly that he kept no records of ATM deposits or anything else to corroborate that.

 

“You don’t have a single solitary deposit slip to document depositing … these thousands of dollars,” the money?” Gillen asked.

“Not a one,” Wade responded.

 

 Over more than 15 minutes of questioning, Wade said he has no away of documenting any of the case (sic) Willis purportedly gave him. And he said that in a discussion of the controversy with Willis, he didn’t ask her if she had a way of documenting that she reimbursed him for trips to Aruba and elsewhere.

Da fanny is really making da mess of this.

 

Couldn't they have got a Democrat judge without such a sordid private life? Surely there are enough to choose from? Or was she a diversity hire?

In 2020, Willis was elected district attorney for Fulton County, defeating Paul Howard Jr., a six-term incumbent and her former boss.

The original motion that brought on this whole issue was filed by Trump co-defendant, Mike Roman, not by Trump although he later filed his own motion.

 

This hearing is on the relationship between Willis and Wade and the financial transactions between them.

 

The comments and media of DA Willis are excluded from the this hearing. But any later ruling on possible jury tampering by the prosecution could have more serious consequences on the overall trial whenever that may be.

ATLANTA (CN) — The state judge overseeing the election interference case against former President Donald Trump turned down a request from prosecutors on Monday to cancel a hearing set to discuss claims of an "improper" relationship between them.

 

During a hearing, Fulton County Superior Court Judge Scott McAfee rejected the Fulton District Attorney Fani Willis' efforts to quash subpoenas seeking testimony from her and eight others who work in her office, including her special prosecutor Nathan Wade.

 

“Because I think it’s possible that the facts alleged by the defendant could result in disqualification, I think an evidentiary hearing must occur to establish the record on those core allegations,” McAfee said.
