Using your child to obtain a guardian visa, possible ?

Is it possible for a parent who has no job connections whatsoever with Thailand to obtain a Guardian Visa just to stay long-term in Thailand by sending the child to an international school in Thailand ?

 

I have always thought the child's visa is sponsored by the parent, so that the parent must at least have some legal reason to remain in Thailand, and then the international school will accept the child to study in the school and give her an Education Visa.

 

Is the opposite way possible ?

Possible, if you have 400,000 baht in your Thai account and sole custody of the child granted by the Thai court

Will you be working for a foreign company or as a freelancer while living in Thailand? If so, you would need the appropriate visa and a work permit. You will also be liable for tax.

Yes possible, that's one of the reasons there are so many Russian children in International Schools. The schools help with all the necessary paperwork

you don't need sole custody, as that is almost impossible..at least shared and a place to live for you and your child and prove it with funds 400k , photos of your place and all the rest...

Evidence of employment is not a requirement in this case.

The child is not a Thai.

IF so... I think there is scope for you to apply for a Immigrant Type O visa based on Guardianship of a non-Thai child minor who holds an Education Visa in Thailand.

 

 

Yes, you are absolutely spot on.

 

It feels so strange that the parent has no business to be in Thailand for a long term, but is able to piggyback on a child's education visa.

It's not a Thai child, so there is no issue of sole custody granted by Thai Court.

not piggy banking, will be very expensive and perfectly legal choice to stay and support kid's education

Why would an employee of a foreign company outside Thailand, not working or earning income in Thailand need a Thai work permit and work-appropriate visa?

Because it say so in the labor law. If you work while living in Thailand you need a work permit, doesn't matter where the money comes from.

In this case, it is clause 2.9 of the cited Police Order for your child, clause 2.11 for you.

Yes, as parent – and the child can be a foreigner – many international schools will help you with the process.
