Trump, others can appeal Fani Willis removal ruling, judge allows
Judge Scott McAfee says he’ll continue work on other aspects of case

Fulton County Superior Court Judge Scott McAfee on Wednesday granted permission for former President Donald Trump and seven others to appeal his recent decision that has kept District Attorney Fani Willis at the helm of the election interference case.

 

McAfee issued a “certificate of immediate review,” which allows the defendants to appeal his ruling to the Georgia Court of Appeals before a trial begins. It will be up to the appeals court to decide whether to take up the matter.

 

“The requested motion is granted,” the judge wrote in a short order, which also makes clear he’ll continue to work on other matters related to the case in the meantime.

 

“The Court intends to continue addressing the many other unrelated pending pretrial motions,” he added, “regardless of whether the petition is granted within 45 days of filing, and even if any subsequent appeal is expedited by the appellate court.”

Great to see the judge's pathetic ruling appealed.

 

Even during questioning he was acting like Fani was his boss. Almost apologizing when ruling against her or telling her to get to the point instead of avoiding the question with 5 minutes of babble. He should be investigated, he seemed either terrified of her or infatuated with her. Maybe he's another "good friend" of hers? She seems to have had many.

Forget the Georgia case, I knew those good ol' boys would circle the wagons.  They've probably already planted a wholesale quantity of cocaine in her garage.

Florida might get the cavalry riding in, but I doubt it.

DC Jan6 case is really the only one, though more charges will come to light.  After he loses the election there is going to be the whole clown show like in 2020.  Nancy Mace will be the new Sidney Powell.

Whatever he decides, Judge McAfee has already earned the respect of a variety of legal experts. Among them is Norman Eisen, who served as special counsel to the House Judiciary Committee during Mr. Trump’s first impeachment. Mr. Eisen has been vocal in supporting the Georgia prosecution, and has argued that there are no legal grounds to disqualify Ms. Willis.

 

But he has also called on Mr. Wade to step down, and he defended Judge McAfee’s decision to hold hearings on the matter.

 

“He is one of the most capable new judges that I have ever seen, and he has navigated an extremely challenging situation with grace and intelligence,” Mr. Eisen said.

The defense has also taken issue with several statements Willis has made outside the courtroom, including the implication that their motion to disqualify her and Wade was racially motivated. 

 

After Willis suggested during a church speech that the criticism Wade faced stemmed from being the only Black special prosecutor she hired, Trump attorney Steve Sadow accused her of attempting to “foment racial animus” against Trump and his co-defendants to take focus off her alleged affair.

 

More recently, Willis told CNN that the “train is coming” for Trump and his co-defendants, drawing more criticism from the defense.

Now that’s funney forment racial animus ho ho ho dear lord does anyone remember trump trying to foment violence after the George Floyd murder?or how about him using the riot police to attack peaceful demonstrators in front of the black church so he could wave the Bible around upside down…….holy cow…….then he scurried down to the bunker and tryed to compare himself to Churchill during the blitz……they really do have no shame nor bottom.blubbering about the train a coming for trump really???meanwhile trump threatens and disparages the whole judiciary and says he’s gonna get even…….come on…..it’s farcical

There was an article in the NY Times that I quoted March 22 elsewhere this Forum that said -- in  specifically referring to the 2 Federal criminal cases -- that the Justice Department considered it "inconceivable" that Trump would be anything but a has-been full time at Mar a Lago and ostracized by the Republican Party. Not someone who would be the leading candidate for the Republican Presidential nomination.

 

They and maybe the other Prosecutors figured Trump would just play nice.

I understand your frustration.

It’s indeed ironic that Fani Willis, as Attorney General and only a defender of Georgia law, is expected by figures like Trump and perhaps by the law itself, to uphold a higher standard of conduct and propriety, not just in her professional capacity but also in her private life.

This expectation seems paradoxical when compared to the conduct of a president who, upon assuming office, has or will pledge to ‘preserve, protect and defend’ the Constitution and thus defend the law of the entire U.S

Personally, I consider the outcome of all these Trump legal entanglements criminal or civil to be a side-show compared to the prospect of Trump again being President JAN 2p025.

Are there any judges for  Trump's cases for  whom you have respect?

But as long as she gets Trump that's all that matters. If she's to put him jail, she'll be replacing Sotomayor. She could actually make Sotomayor look bright...
