Judge Aileen Cannon handed down her decision on Monday in a big win for the former president. The Florida judge overseeing Donald Trump's classified documents case dismissed the indictment against the former president Monday on the grounds that the appointment and funding of special counsel Jack Smith was illegal.

The Justice Department, the special counsel's office and the Trump campaign did not immediately respond to requests for comment.

This is a developing story.

Can't argue with an argument as legally sound as that.

This will be almost certainly be appealed to the 11th circuit, who have aleady reversed Judge Cannon twice.

The appointment of special counsels had been settled law for decades. Multiple courts, up to and including the Supreme Court, have upheld their legality in the past. Of course if it gets as far as the current SCOTUS, who knows?

What it does mean of course, is that there is absolutely no chance of this case ever getting to court before the Presidential election (not that there was really much chance of that happening anyway).

Do you have a Venn diagram of that?

I'm Kamala has a Venn diagram as she has stated her love for Venn diagrams during many of her word salads speeches.

I’m sure this news will cause a lot of mass depression on the left, there’s probably going to be a run on antidepressants at the pharmacies.

I agree with this caveat to lucid Americans this ruling the supreme court’s ruling trumps track record and the chaos he creates will harden the resolve to get rid of this scofflaw let the trolls and bots chortle….we haven’t forgotten what trump did we all have seen it with our own eyes we all see how partisan this ruling is and I believe it will be overturned on appeal
