Thai tax tangle: Expats warned of new rules on overseas income

Conflicting information again, which is the problem with this whole business. I've been advised by a lawyer that UK ex-government workers, exempted by the UK/Thailand DTA, are not required to file here.

Correct if you only transfer your government pension ( not same as state pension fir other readers as I am sure you know the difference already).

the advice is clear: obtain a tax identification number and file a return by March 2025

Another event to promote an accountancy firm and tell everyone what they already know, I bet the poor Pattaya xpats left the meeting scratching their heads and more confused than when they walked in, I would need a beer after that!

I think most xpats if they don't have a family here, and none will own property in any case will just hop on a plane should they come looking for back taxes.

Totally agree, Its never been thought out properly, How are they going to implement this ,how are they going to enforce it, as for me i will just wait till they knock on the door !! never paid Tax for over 15yrs  not going to start now

I'm forever reading about the 'new rules' on this forum. The fact is, that as far as us retired expats are concerned, there are no 'new rules'. In theory we have always been liable to taxation, however it's clear that the TRD have, thus far respected the terms of our DTAs and left us to get on with our lives. Plus the bonus of having us bring lots of extra money into the economy and in many cases supporting families as well.

IMO This situation has not been created by TRD, it's come about by certain meddling amateur tax advisors on this forum (and we all know who they are) and greedy professional tax advisors looking to make a killing.

I do not believe it's a case of not been thought out properly. I don't think it was even contemplated in the first place.

Am in agreement  but the problem bearing in mind T.I.T that we may suddenly find a frozen Thai bank account one fine day

If they're going to enforce this and thats seem highly likely they'll find a way to make everyone comply

"Who's there?"

"Thai Tax Man"

*KNOCK KNOCK...KNOCK KNOCK KNOCK...KNOCK KNOCK KNOCK KNOCK*

Could be.

A year from now you get a knock on your door.  You look thru the peep hole and see a smallish younger Thai man with glasses and a pen in his shirt pocket. He is holding some files.  You decide to open the door and he yells in your face: why didn't you file your Thai taxes!

Yawn and it is obvious you think you know much more than you actually do on this subject.

Your above posts are hilariously void of anything other than the story you have made-up in your head on how "all" things regarding expat taxes in the future.  How can you not see this? Carry on - these threads are fun.

Si don't believe me then. I have taken tax advice from professionals but I am sure you have a sour attitude to that. Up to you.

Duh! American international tax confusers. Wrong on credit card transactions too. Case of attempt at self promotion blowing up in your face 🤣 Nowhere in the new rules does it say the word “foreigners”.  Think really hard about this. Who were the TRD targeting? And work backwards from there.

Already started making plans only gonna leave in my Thai bank account what I need to spend, cant pay back taxes with what I don't have, then if I get a bill or a frozen bank account bye bye Thailand.

Don't worry, the others will be given their chance to present also.

If by 'others' you are referring to other tax advisers it seems to me they've been presenting non-stop for months past.

More likely nit extend your visa without clearance from the Thai tax authorities. It's simple fir them. Just need to take a tax filing return to immigration on renewal day like the bank letter. Then YOU will be scurrying to file a return. It will only come ti that probably soon when they introduce global taxation. That's the bombshell awaiting all.if us.

Let's guess, did you take your advice from:

A) a slick presented, foreigner fronted 'expat' tax specialist that sprung up less than 18 months ago?

Or

B) did you take it from an established firm that has actually had experience filing Thai taxes , and dealing with the TRD, over many years?

Another expat company not legally allowed to practice in Thailand trying to drum up business by scaremongering people.

Are you sure you are not a tax advisor 🙂
How are they going to enforce it?  Not extend your visa? There are a few friendly IO's around that will require some form of tax 😉 but cheaper and less administration/paperwork!
Other countries they send bailiffs to your house to seize property etc, how can they do that when foreigners don't own anything here? 🙂
I can't imagine the banks in a hurry to freeze or close peoples accounts down doesn't make much business or financial sense for them to do that!
Are they going to send foreigners to jail here for not paying taxes?  Can't see that happen either the jails would be full and would cause a bit of an international outcry and give Thailand a 'bad image'
Would also be against human rights in general to restrict your travel on the basis of any tax debts.

Money for Condos- Carden admitted such matters remain unclear, hope that clears it up.

I don't think the tax law has any mentions about how transferred funds are spent, so does not matter you buy condo or sex. What matters whether the send money is income or not.

Wonder based on what Carden speculated condo funds might have some special treatment based on usage

Hahaha - that will be withdrawn before they ever get near my bank account I doubt even Thailand would just take that out without giving you some kind of warning.
If I was a cynical man I would suspect that the government may want to get their hands on everyone's 800000!!!!!

So, if they do things "the normal way" they'd calculate your taxes like this.

This small spreadsheet to compute taxes provided by 'pauku1' is pretty nifty.

Yes

the DTA says is not taxable in Thailand

I think Untrue.

Only untaxed In-Kind, that is Thai tax rate is equal or less than foreign tax rate. But when the Thai tax rate exceeds foreign tax rate  (ie., 25% vs. 20%), a Thai tax might apply to the differential. That should not violate the DTA.

Oh dear. Depending on hopefully you can pay bribes to stay in thailand is not only unethical and unlawful it's also improbable in the long run. Grow up.

Not going to waste my time replying other than advising you to reread prior threads going back years with your same argument above and "no" real knowledge has been gained.   As I mentioned prior - carry on for the many AN members that find these threads hilarious.

I saw this and he is correct in saying that unless you remit funds that are taxable in thailand then you don't need to both get a TIN or file a tax return. He does seem.unhinged, however!
