    That's a pretty big difference between owing 14,000 THB and owing NOTHING!   What are they doing, throwing a dart and seeing where it lands for any given filer???  🙂

  • I will add the low level officials told me not to bother filing.   The senior official said they were wrong, they should not have said that, and he would speak to them about the new rules.

This is the problem.  The local officials don't always know their own regulations.  They won't look it up when customers, especially the foreign kind, are watching.  Then when they inevitably make a misteak, they won't admit it.  They'll keep massaging the numbers and filling in random blanks until it looks sorta, kinda, possibly not completely wrong.

 

You brought in only pre-2024 savings last year.  You had zero assessable foreign remittances, have nothing to declare, did not cross the filing threshold, and don't need to file.  Simple as that.

 

Unless you had sufficient Thai-source income, you don't gotta do nothing.  You file only if 1) you want a refund of interest withholding tax, or 2) you want to have a history of filing because you don't know what will happen in the next few years.

 

Three hours is ridiculous.  You can file online from home in your underpants in about fifteen minutes.

I will now tell you what happened.

 

He filled in the wrong columns. Different columns on the computer for different stats, as in those bringing in assessable income and pensions income etc

 

He then smiled and said he had filled in the wrong columns and didn't get it why, after three hours, I was a tad unhappy.

 

He showed my partner the computer and where he had done it wrong.

 

Furthermore, he didn't know what he was doing.

 

The senior officer at another desk just continued talking on his phone and ignoring us.

 

He actually told me now I was in the system, he would rather I did it myself online.

There are no columns for NON-assessable income, and no provision for deducting if declared.

 

But go check out this other thread.

SO, THAT'S HOW HE BUGGERED IT UP AND CONFUSED HIMSELF.

They probably will do as u turn on this tax for foreigners, as they have got it, many are disgruntled.

On the basis of "TiT" there MAY be a need in the future for individuals to show why they didn't file.  

 

As I have said, imagine every single expat simply saying, "My income is non assessable" even when it is actually assessable.  It can't be that easy to avoid this tax. 

 

At some point, they are going to want to see proof of source.  They already know the amounts, just not the source. 

 

A tax policy without enforcement is no tax policy at all.  This policy will evolve.  Be prepared.

There may be though in a typical retiree's case not very likely unless red flagged for some reason.

If an individual is any doubt whether his income is assessable or not, he should seek professional advice at some point.

 

I don't really understand what point you are making .If income is assessable then a tax return is needed.If it's not then it isn't.The guidelines issued are quite clear.

Once again the key aspect is to make sure you have proper records so you can demonstrate no asssessable tax to pay and thus no return needed.

 

Of course tax policy evolves and , as it does , adjustments are needed. It's the same everywhere.

Well. Look on the bright side. It has been a learning curve. What you have learnt is that when the Thai government departments make grandoise announcements regarding new laws or crackdowns just ignore them or file them away on a dusty shelf at the back of your mind.

 

Just keep up with immigration rules and  DON't overstay your visa. Everything else can be dealt with if it becomes absolutely necessary.

 

Wife never filled in a TM30 for 30 years as I was doing 90 day visa runs.  When I was finally obliged to switch to doing an extension because of Covid the immigration officer asked for a TM 30. We looked blank and we just paid the statutory fine of 1700 baht.  No hiisy fit , nothing . All smiles and see you agains. Not bad for 30 years.

That's why I laugh at people who are soooooooo careful with their 800k baht seed money, and their extension date, but are prepared to do nothing about this tax policy.  

 

Can you see how one may be exposed to extortion, given what's at stake, with a potential criminal charge?

Tell me why I should put myself under a spotlight by going to a tax office. Tell me what crime I have committed by letting them come to me.

You will go to the them at extension time or at a boarder.  That's why this method of compliance and enforcement is perfect for them, but you call it scaremongering.  It's laughable.

I did my last extension in November. Tax ID or returns were not mentioned.

 

My next extension will be prepared one month before the due date. Plenty of time to adjust if necessary.

Do your own thing. You'll then be on their radar, and be liable to be messed around by experts. Bet you haven't thought of that consequence of trying to be a goody two-shoes.

I've always said I will be using an agent.  Nothing has changed from that.

The agent says he can also "negotiate" my tax liability. Some business owner friends here have confirmed this possibility also.    Too funny.  Real 3rd World Country stuff.

Unlike yourself, I actually hold his tax policy, which does have criminal offenses attached to it, in the same regard as immigration policy, and that is, it is imperative to comply.
