If they were ACCUSED of a crime and got bail and then (or before had) applied for asylum as a refugee, I would have no problem with him (or her) paying the bail or arranging for a bond and going free BECAUSE they are at that time, as all accused are, pressumed to be innocent. If they were CONVICTED of a crime, I would expect them to be given the same sentence as anyone else found guilty of committing that crime, and after their sentence was done, ICE could detain them, refuse their asylum application, and deport them if they thought that was best.

Any alien accused of a violent felony should be held without bail as a flight risk. When citizens get bail it is verified they are known in the community, have a job or place to live etc. Your arguments are completely absurd. So let the illegal out on bail with a pending rape charge... okay where do they live or work to be productive? Part of being granted bail is an ability to demonstrate you aren't a risk to the public. 

 

Presumption of innocence applies to court proceedings not bail hearings. If you were presumed innocent you wouldn't have been arrested.

I agree that aliens should have less of a chance of getting bail than US citizens. Many of these aliens do have jobs and a place to live. Granting bail is primarily to ensure that you show up at the next scheduled hearing. but I agree it also is dependent upon the type of charges you face.

The police that arrested you do believe you MIGHT be guilty, but the judge has to presume you are innocent. That's my understanding of how this works.

The police that arrest you believe your ARE guilty. At trial if you choose to go with a jury they have ther standard of the presumption of innocence. The judge must be impartial in the proceedings. There is this notion that everybody in the public must give the presumption of innocence and that isn't true it only applies to the jurors alone.

Well, if we, the public, judge a person, I believe we should presume that person is innocent, just like the jury. Also, we, the public, aren't given all the information the jury gets, but we also get a lot more via the news. If you watch Fox, you'll probably have a different opinion than if you watch CNN, as I do.
