Philippine Supreme Court Upholds Legitimacy of Renewable Energy Tariffs

In a landmark decision, the Philippine Supreme Court has upheld the provisions of the Renewable Energy Act of 2008, affirming the roles of three key government agencies in the implementation of fixed tariff systems for renewable energy. The court's 118-page decision, dated August 13, 2024, confirms the authority granted to the Department of Energy, the Energy Regulatory Commission (ERC), and the National Renewable Energy Board (NREB) under Sections 6 and 7 of Republic Act 9513.

The ruling reinforces the mechanisms designed to promote renewable energy development in the Philippines, including the Renewable Portfolio Standard (RPS) and the Feed-In Tariff (FIT) System. The RPS mandates power suppliers to source a minimum proportion of electricity from renewable resources, while the FIT System provides incentives for renewable energy developers through fixed tariff payments and priority access to the grid.

Challenges and Rulings

The constitutional validity of these provisions faced opposition, with petitioners claiming that Sections 6 and 7 were vague and improperly delegated legislative powers. They also contested the advance collection of the FIT Allowance on consumer electricity bills, arguing it violated due process.

However, the Supreme Court sided with the agencies, affirming an earlier Court of Appeals decision. The court clarified that Congress could delegate rule-making and rate-setting to administrative bodies with necessary expertise, and declared the Renewable Energy Act comprehensive with clear standards.

On the issue of FIT Allowance, the court found that pre-collection is legal and crucial for maintaining the financial viability of renewable initiatives. By collecting funds in advance, the policy accelerates the development of renewable infrastructure, ensuring consistent support.
