Officials involved in a controversial sand dumping incident in the West Philippine Sea may soon face legal charges, as Malacañang has indicated potential breaches of Philippine law. The incident, currently under investigation by order of President Marcos, could lead to charges under the Philippine Maritime Zones Act and the Philippine Mining Act.

 

In a press briefing on May 14, Communications Undersecretary Claire Castro stated that the investigation is sensitive and privy to ongoing scrutiny. As such, specific details cannot be disclosed at this time. However, Castro confirmed that violators could be prosecuted for infringing Republic Act No. 7942 (Philippine Mining Act) and RA 120641 (Philippine Maritime Zones Act).

 

"This is now under an ongoing investigation, and we cannot reveal the details because this is quite a sensitive issue," Castro remarked, emphasizing the gravity of the situation. "Whoever is found violating this may face charges under RA 7942 and RA 12064."

 

The Department of Environment and Natural Resources (DENR) will lead coordination efforts with the National Intelligence Coordinating Agency (NICA), which reported that sand from Philippine coastal areas is allegedly being used in reclamation activities in the West Philippine Sea. Additionally, the investigation will involve the Philippine Coast Guard (PCG) to ensure thorough scrutiny.

 

The proceedings follow Malacañang's announcement on May 7, where the President mandated a probe into NICA's claim about sand extraction from the country's coasts for reclamation projects. Inquiries about accountability for local government officials are contingent on the investigation's findings.

 

As the investigation progresses, further actions and disclosures will depend on concrete results, ensuring those responsible for any violations are held accountable. The situation highlights the delicate balance between national resources management and legal compliance in the West Philippine Sea.
