I'm on a marriage extension and have no idea how retirement visas work.

 

A friend rang me tonight.

He was on his first retirement visa which he thought expired next month.

 

Unfortunately, he either misread or likely forgot that it expired 2 weeks ago.

He is now on a 14 day overstay.

 

He will go to Immigration to clear up the 500 Baht per day overstay fine tomorrow.

 

What is the procedure then, does he need to apply for a new retirement visa straight away?

To make matters worse, his passport (US) only has 1 blank page.

 

Would appreciate any advice as he's quite worried.

If he meets all the requirements for a 1-year extension, chances are they'll let him pay the overstay fine and still process the extension. But he better makes sure that his application is flawless and that his remaining blank page is in fact a usable "visa" page, not an "endorsements" page.

Has not done an extension. 

So this was to be his first? 

To even consider trying to obtain a 12 month extension the 800k must have been in bank for two mo tha to meet compliance. 

 

Your post is tad confusing. What do you mean.,.. What actually expired. 

The Non O or the 90 day stamp.Check passport to see date of current permission of stay. 

 

Given only one page remaining in pp then not good situation.

know he was doing 90 reports online, so maybe he meant this was his first extension.

 

The money has been in the bank for 12 months plus so that won't be a problem.

 

I'm not sure if this makes a difference, but the original visa/extension was granted in another province.

 

He has relocated and is hoping he can reapply in Chiang Rai.

 

I guess he will find out today when he goes to Immigration.

Well if he's doing 90 day reporting then he's definitely on an extension of stay. 
 

At most offices a short overstay isn't a problem (under a month or so) and you just pay the fine apply for a new extension and they issue it to you 


The "one page left" is much more concerning, because IF they have an 'old style' US passport that the last couple pages are marked 'endorsements' many immigration offices will not put extension stamps on those pages. 


As other posters said, he needs to get his ducks in a row documentation wise, get to his immigration office, clear the overstay fine and apply for the extension (if they will let him) ASAP !!

Since he has been doing 90 day reports then he must currently be on a 12 month extension. 

So this extension coming up is not his first extension. 

Appears simple case of missed his expiry date and didn't apply for next extension. 

This happens and immigration can opt to allow payment of overstay fine. (as @Caldera explained) 

More common would be few days overstay. 

Today will be very interesting for him. 

Has he done a TM30 for this new address.  One page left in pp is the wild card. 

Please post any update.

Just for peoples' information on the OLD United States passport this is the difference between "regular" passport pages and those last pages that are for "endorsements" that immigrations won't usually stamp

OK

Here's an update.

 

Please note I am getting this 3rd hand as my friend's lady did nearly all of the talking and

he relayed it to me.

 

Immigration refused to process the new extension as he was on overstay.

They didn't allow him to pay the fine.

 

He was told to go back to the province where he originally lodged his first extension using an agent and reapply there. 

 

I'm not sure if this is the norm.

Either way, he's flying today to contact the agent and to try and get things sorted.

 

Immigration never mentioned the fact that he only has 1 free page in his passport.

I don't know if they even looked TBH.

Not sure what an agent can do for him. 

Did he use agent for current extension? 

Also you didn't mention the immigration office he is returning to. 

 

My advice would have been to exit Thailand and pay overstay on exit at airport. 

Hopefully reenter visa exempt. 

However not sure how his only one page in pp will hold up. 

Both with immigration and airlines. 

Suggest his ordeal far from over. 

Let's us know how he gets on.

He used an Agent for his current extension.

The original office was Chonburi.

 

If they accept the 1 page in his passport, I imagine it gets processed.

Then obviously he will have to get a new US passport.

 

Will find out soon enough I imagine.

Unless the agent was just hand holding exercise he should/would be aware that after using agent facilitated extension it is virtually impossible to DIY and would need to use agent ongoing. 

Apart from overstay mistake seems he failed to do TM30 (change of address) at new office. 

Even if not in overstay the new office would not process extension.

IMO he has 2 choices. Go back to the Agent in the other Province and ask him/her to sort it out - and pay for that. Or as Jack said - leave the country and pay the fine and get a new passport and reapply for a new Visa. 

 

That he has no spare pages in his passport is a big concern to me. What has he been up to and where has he been and what has he been doing - and why would he not know the rules if he is that well travelled?  I think you need to be careful mate. How good a friend is he really - I would stay away and not get too involved with this bloke - sounds like trouble to me.  If he is internationally travelling a lot and cannot organise his Visa etc. then he is a problem - the type that will dump those problems on others - the type best avoided. Be careful mate.

Who, apart from your mate, leaves it until now with only one page in their passport when they need to renew their extension of stay?

Why do people wait for the LAST SECOND to renew a passport.  MANY IO's will NOT renew EXTENSIONS with only 1 or 2 blank page in PP's. 

 

It sometimes takes 4 to 6 weeks getting a new US PP. I applied 8 weeks before mine expired, edded up getting a 1 year EMERGENCY PP ( 2 days before my extension expired ). Then, 2 days after extension done, 10 year PP was ready - 2 trips

1) to  get PP and

2)have stamps 'transfered'.

 

Apply fo NEW PP 3 months ( to be safe ) BEFORE it expires, AND when you have only 3 pages available for stamps. A TRAVELED PERSON SHOULD KNOW THIS and also keeping the TM-30 UP TO DATE.

 

Yearly, I buy a calendar and mark the 90 day and extension dates.  Has worked 12 years for me.

NOTE:  Some offices will allow you to do your 90 day up to 5 days early.

a ''EXTENSION" up to 45 days early - you loose no time on extensions.

Why not just enter dates onto Google Calendar with reminder.

90 day reports can be made between up to 2 weeks prior to due date and One week prior.

In this case he would need to apply for a fresh non-O visa before re-entering the country. This is because the option of a 90-day non-O conversion of a visa-exempt entry at his local immigration office won't be available in his case since he has been on overstay:

Ask Khunheineken, he claims they don't know because everyone get same stamp, which I told him is incorrect
