Report Nestlé Case Moved to Intellectual Property Court, Operations Continue in Thailand

In a significant legal development, the Appeal Court for Specialized Cases has decided to transfer a case involving Nestlé from the Minburi Civil Court to the Central Intellectual Property and International Trade Court. This ruling ensures that Nescafé products will continue to be available in Thailand.

 

The case, initiated by the Mahagitsiri family, challenged Nestlé's rights to produce, sell, and import Nescafé products in the country. Nestlé requested the review to determine the appropriate court jurisdiction, leading to this decision.

 

At 9:00 am on June 20, the Minburi Civil Court announced the decision, which allows Nestlé to maintain its operations in Thailand, including the production and sale of Nescafé.

 

The original filing, case number Phor 517/2568, was brought by Chalermchai, Suvimol, and Prayudh Mahagitsiri. They sought a temporary injunction from the Minburi Civil Court to halt Nestlé’s operations concerning Nescafé. The defendants included various Nestlé entities.

 

An urgent hearing was initially set for April 11, 2025, but postponed to April 17 due to the Songkran Festival. During this hearing, Nestlé's defence team requested the case be moved to the Central Intellectual Property and International Trade Court, arguing the jurisdiction was more suitable there.

 

This judicial transfer allows Nestlé to continue its business activities in Thailand while the case is adjudicated by the specialised court.
