I don't "blame" NASCAR for organizing one of the most boring sports on the planet any more than I "blame" Budweiser US for producing a foul tasting carbonated liquid they have the nerve to call beer. My opinion wouldn't count for anything anyway, since it are the courts that will decide. Of course the appeals court isn't the last option, but that doesn't mean he will win when it goes to the supreme court.

 

Fact is, if there were no doubts, there would have been no case be accepted by the lower courts.

No, a U.S. court will not accept every case filed. While federal courts have jurisdiction over specific types of cases, they still have the discretion to decide which cases they will hear. The U.S. Supreme Court, for example, only accepts a small percentage of the cases it is asked to review each year.

yes it will, because a case doesnt start until its filed. I guess you are confusing jurisdictional objections made AFTER the case has been filed.

The Court does none of that ab initio.
