Buying property in 7 year old sons name

just wondering if someone can point me right direction in terms of understanding the laws regarding buying and owning property in Thailand. 
 

I have a 7 year old son who is dual citizen Danish/thai. Im divorced from his mum, but he was born in Thailand, has a Thai passport and is registered at her parents adress. He lives with me in Danmark. 
 

He is my only kid so he’ll inherit everything from me (eventually). Could I buy something in his name and get access to property that you couldn’t buy as a non Thai. citizen? I guess you also do it an a company where he is the shareholder?

Yes you can, but no credit and you must get his mom's permission as one parent needs to be named as 'manager' by mutual parental consent.

Well, I have done that long time ago. My son was around 7-10 years old. I was divorced from his mum. My son has dual citizenship. He is now 26 years old.

i bought a house using company that time (my son was not listed as share holder). Few years later, I transferred the ownership of the land (chanote) to my son and had my son registered as master in the tabien baan. Then, I closed the company. I used a lawyer to do this process and it was smooth.

since, my son is “the owner of the land and the house”. 
when I registered to the immigration my address in Thailand (can’t remember the name of this), I went to the immigration with my son as the owner of the property. Everything went smooth.

Yes, you can buy property in Thai child's name – i.e., the minor Thai will be owner under guardianship. If you don't have full custudy it might be his mother that will be guardian when registering the property at a Land Office. Any servitudes – like usufruct or superficies – and like that needs to be registered oin the land title deed must be made before transfer to a minor, as it might otherwise be somewhere between difficult to impossible to have it registered before the minor owner is 20 years old. Alse be aware of that it might be impossible to sell or transfer the land while owned by a minor.

 

If you wish to build something on the land , you need the minor's permission – i.e., from the guardian – and it must also be in the interest of the minor. You will need a building permission from the local tessa-ban office to make any legal construction on the land.

 

As for a Thai company limited a minor can be shareholder. After the latest adjustment you only need two shareholders to form a Thai company limited, but a foreigner can only own 49% of the shares; in some cases 39% upon registration of land that shall be owned by the company limited. However, you don't need a company – and the costs involved – if you let your Thai national son be owner of land. Also be aware of that the Thai shareholder(s) must prove access to funds for investing in shares, and that a Thai company limited cannot only be used for ownership of land for a foreigner; the company limited also needs to perform some "normal" business.

 

I'm also Danish. My dual national daughter is both shareholder in a Thai company limited and owner of land.

As far as i know regarding condos, your child needs to be 20 to buy or transfer in their name and not involve the mother
