Yes, Colbert could perhaps have agreed to invite other politicians at another time, but why should he as up until now the late-night shows have been exempt from the equal representation rule.

They haven't been exempt. It's that the rule wasn't applied. Again CBC DID NOT prevent Colbert from airing the show they simply pointed out that equal-time could be an issue. Colbert chose not to air it and go online with it.

It was “The Late Show” itself, CBS said, that “decided to present the interview through its YouTube channel with on-air promotion on the broadcast rather than potentially providing the equal-time options.”
