Supreme Court Strikes Down Trump Tariffs (Live Coverage)

The Supreme Court's $100 billion-plus tariff ruling is out and it flatly rejected the White House argument, saying that the International Emergency Economic Powers Act "does not authorize the President to impose tariffs."

An adverse ruling for the White House opens up a hole of well over $100 billion in the annual budget, since the tariffs are, in effect, offsetting part of the cost for the One Big Beautiful Bill Act tax cuts. Refunds may also be due. The outcome of the case, therefore, has important implications for the fiscal deficit, interest rates, President Donald Trump's legislative agenda and potentially the midterm elections.

Today, economists at Penn-Wharton said that over $175 billion in tariff revenue may need to be refunded if the Supreme Court rules against Trump's tariffs.

However, according to SCOTUSblog, the court mentioned nothing about whether the government should go about returning the billions of dollars it made from importers.

Justices Clarence Thomas, Brett Kavanaugh and Samuel Alito all dissented.

Justice Kavanaugh in his dissent, said: "The United States may be required to refund billions of dollars to importers who paid the IEEPA tariffs, even though some importers may have already passed on costs to consumers or others."

There are THOUSANDS of lawsuits claiming refunds of tariffs, and some of them are by the biggest companies of the US, like Costco and Walmart.

My understanding is that even when those refunds are granted by the court, it may take years to have them actually be refunded.

The Supreme Court has been highly partisan of late and when they rule against Trump with the majority like this, this is a truly great day for America, a huge victory for democracy, and an enormous slap in the face for Disaster Don. The circus clown who claims to be a law and order president is in reality the exact opposite of that, he fragrantly disregards the law every opportunity he gets, and finally the Supreme Court has thrown a huge omelette onto his incredibly ugly face, and in the process dispensed a great deal of justice.

It's all downhill from here Don, get used to failure, get used to loss, get used to rejection, get used to being powerless and doubly impotent.

President Trump’s wide-ranging tariffs have helped to reconfigure trade. Agathe Demarais, a senior policy fellow at the European Council on Foreign Relations, noted that American allies and adversaries have been reshuffling trade ties away from the United States. “China recorded a $1.2 trillion global trade surplus in 2025, the highest-ever on record by any country — highlighting how Chinese firms successfully re-routed exports to other markets.” Over the past year, countries across the world have stepped up efforts to sign trade partnerships that do not include the United States, like the European Union’s recent deals with with the four South American nations that make up Mercosur and with India.

The National Retail Federation, a trade group, expressed relief about the Supreme Court’s ruling, The ruling “provides much-needed certainty for U.S. businesses and manufacturers,” said David French, the group’s executive vice president of government relations. Refunds, he added, “will serve as an economic boost and allow companies to reinvest in their operations, their employees and their customers.”

Very good assessment. The whipsaw tariffs have been a disaster for small businesses in America and have dramatically lowered consumer confidence and increased fear of uncertainty.

Trump gets another F grade. Don failed yet again.

As a practical matter it does nothing but demonstrate the independence of the Supreme Court since Trump can reimpose Tariffs tomorrow under several other statutes, and even make folks waive "refunds". Its a correct ruling as to the issue. Congress should do its job regardless and simply add tariffs to the Law at issue.

Investments require a stable and predictable environment to thrive, as stability lowers risk, encourages long-term planning, and protects capital. Investors prioritize transparent, consistent, and safe environments with sound regulatory, legal, and macroeconomic frameworks.

At present the Unites States is far from providing a stable and predictable economic environment. This doesn't mean that there will be no investments in the US. While high volatility can deter investment, it can also create opportunities for risk-tolerant investors seeking for high yields.

These are the investors who typically invest in countries where the rule of law is frequently trampled upon, where instability and political extremism are a source of constant uncertainty, and where capitalism can only develop in its most rapacious forms.

They are hit-and-run investors, seeking high returns in a very short time and certainly not concerned with creating long-term opportunities and jobs.

The SCOTUS ruling sadly confirms that the United States has become a nation where the rule of law is no longer guaranteed.

Whether one agrees with SCOTUS, admitting that the president acted illegally, or agrees with POTUS, believing that the Supreme Court has become a court of radical leftists who only want to see the nation fail, the conclusion is that the United States is no longer a state governed by the rule of law.

Never has the economic well-being of the United States been so threatened as in this moment of internal struggle between state powers and between the government and the opposition.
