Dear all,

Is there anyone can tell me if my Chinese Civil Partner could apply EEA family permit for another European countries?

I am a British citizen have been registered civil partnership with my Chinese partner

last year in the UK . My Chinese partner had very poor UK immigration history in the past ,have been in the

country illegally almost 10 years ( applied asylum before but have been turned down by the home office , then they never done anything just left him alone), because he entry the country illegally under other's name so the homeoffice nolonger trusted him anymore.

Anyway few month ago he returned to China and try applied for the settlement Visa, but was turned down by the visa section in China( I am not surprised at all , but just feel a little disappointed and upset ) in the end we have never applied for the appeal to against the decision ,because we know this will be waste our time.( no win situation)

After his application been turned down I decided to move to China and left my job in the UK , I am now living and working in China so I can be with him .At moment we both working and my annual income it's around 18,000GBP -19,000GBP and he is earning around 6000GBP per annual in Shanghai.(not bad as well) currently we living together in his own apartment , His parents are upper middle class in China and they have their own pensions and 2 apartments ( one is for renting) we have around 10,000pounds in our saving account (half in the UK , another half is in the China) after all the utility bills and other money we spent for food , shopping , taxis , travelling we still can save around 800GBP per month every month, in theory we are living in a very good life and don't haveany debits ,so this is our finance situation . We have no intention to reapply for the UK Visa for now as we both know that this going to be tough and even impossible, I don't know what else we can do ??? what chance we are stand on for me to bring him to UK for visit ?? how about Human Right Act will this work on our case? we can prove that our relationship is based on true love and have other evidences .My partner now is only 27 and he spent almost 30% of his life time lived in the UK ,everyone make mistakes in their life time ,he was 17 when he broke the immigration law and he have learnt his lesson already. what can we do ?? if there are any chances for him? So if UK won't allowed him back forever , what about in case my company wants post me to another country in Europe can my partner allowed toapply for an EEA Family Permit for that country so he can join me ? of course he doesn't have any record or poor immigration history in other EU countries apart from the UK, what type of Visa he can apply so we can travel together, we have legal document issued by the British governmentto proof that we were Civil partners ?? Within European Union how many countries do accept UK Civil partnership and treat them just like married couple with all the respects and entitlement? Thanks for the time and I looking forward to hear from you soon. Regards Sami [email protected]

Be however aware that as he has a visa rejected that even for an EEA Family Permit this might refused as being concieved he only registered the partnership as a means to get a visa. You however staying together in China now should give you enough credibility to conquer this.

Also be aware that the EU country has to acknowledge registered partnerships between partners of the same sex. Believe Spain is one of the ones not to easy about that

Thanks for the information everyone :o

Last year my partner has been granted and issued with a marriage visa for (6month) in order for us to get registered in the UK, Lucky we did manage that because the UK embassy didn't check his immigration history at that time, after his settlement application has been turned down the Visa officer have crossed his old 6month Marriage Visa wrote Cancel on his VISA. (He didn't overstay this time and followed the rule get '' Married'' with me.

Does any one know which EU country they didn't want to acknowledge the registered partnerships between partners of the same sex? What about the countries are acknowledged Civil Partnerships and willing to accept it??
