After reading with some trepidation and disbelief the thread regarding application for FLR for the posters wife who made a genuine mistake when applying, next thing they are trying to remove his wife from the country.

This set alarm bells ringing as my wife's settlement visa is due to expire on the 30/11/07. When we originally received our first settlement visa, we stayed on in the LOS for a further 14 days after our visa was granted arriving in UK 15 December.

My question is will we fall foul of the 24 month rule when applying for ILR ?

Any advice would be greatly appreciated.

Your wife will be able to apply between 17 and 30 November, but she 'll also need to meet the language/citizenship requirement and demonstrate that you've been living together as husband and wife since her arrival.

Thanks again scouse for a prompt reply

I thought we would have to apply spot on 28 days prior to the expiry of the visa not a day before, not a day after, for some reason.

My wife has passed her life in the uk test, what would you suggest as proof that we have lived together as man and wife for two years ?

My dates of yesterday are slightly wrong. Your wife can apply once she's been in the UK for 23 months and no sooner than 28 days before the current visa expires. Therefore, based on the dates you've given, she could actually apply any time between 15 and 30 November.

In relation to evidence of living together, the BIA likes to see ten documents for each of the two years (and covering broadly the entirety of each year), five being in her name and five in yours, or a mixture of sole names and joint names. These should come from five different official sources, banks, government agencies, utility companies etc. and must resolve to the same address(es).

Cheers for that Mahout, we have had some more good news today my wife has been out in the LOS since Saturday and today her daughter has been granted her visa to enter the UK so I am expecting them back this Saturday.

I would like to take this opportunity to thank all members on the forum for there help and advice over the last few months couldn't have done it without you.

Your step-daughter's visa should have a validity in line with your wife's; i.e. until 30 November 2007. You can then add her to your wife's ILR application at no additional cost.
