Leave To Remain

Featured Replies

My Friend's sister in Law is Thai. She came to England on a finance Visa. Married (legally) in June 2007 recently paid the £400 for a 2 year Visa, she received the Visa. Last month her husband died unexpectedly. Does any one know what she must do to report her change of circumstance. Money is tight she does not want to pay another £400.

Does she want to remain in the UK? I'm sure she can stay for the duration of her current visa without being challenged but if funds are tight she wont have access to any help from public funds.

She may apply for indefinite leave to remain now on the basis of being a bereaved spouse. The usual fee for this is £750.00. In the circumstances, it may not be chargeable, but I'm not sure, so will have to check. Alternatively, if she so wishes, she can legitimately stay on the two year visa and apply for the indefinite leave later, but this must be done before the current two years expires.

As things stand currently, she can work but cannot claim those benefits defined as public funds. If she were in possession of indefinite leave, she could claim any benefit to which she would be entitled.

Scouse.

Did your friends brother have a private pension? How old was he?

Guys, would she not be entitled to a widow's pension? I don't know BTW, i'm just asking. It would suck if she is not entitled to anything.
