Any advice or help would be appreciated. My Thai fiancee has just had a visit visa refused, it was to be her third one. I am a uk resident. The embassy has described why and we understand. We now want to apply for a fiancee visa and Im wondering, can we apply now or do we have to wait any length of time because of our previous application? Also im baffled as to the requirements - do you have to prove that you have been together six months?

Your fiancée can apply for a visa at any time. There is no requirement to have been together for six months, although the length of your relationship will be a factor in the decision. Six months in the length of time for which the visa will be valid and within which time you will be expected to marry.

Was she refused three times or has she had a visa three diff. times?

If you have been refused /declined 3 times there is obviously something they done like, do you know what it is ?. i have submitted 2 and been lucky in each case ( with the visa,not the fiancees ! ). im joking im still married to the second one,. give us some more info and we can try and help,. Thanks. I'm reading a lot about it at the moment and there are many negative and unsuccessful stories. Is there a long wait for fiancee visas and do you think we stand a chance given that we have known each other 5 months and been living together for 4 months.

Thanks. She has had two previous visit visas successfully but the third was refused. The first was for France, the second for the uk, the third (uk) was refused. They have implied that she doesn't intend to return to Thailand and that her lack of assets and work in Thailand encourages her presence in Thailand. Do we stand a chance with the fiancee visa do you think?

She's had two previous visit visas, the third was refused. I've explained above. Thanks

It's hard to say without knowing the full circumstances. The length of time you have known each other and the strength of your relationship is a factor, but you will also need to establish that there is enough money available from your own resources to support the two of you and that you have somewhere adequate to live.

The requirements to satisfy when applying for a Fiancee visa are different to those necessary when applying for a visitors visa, for a start she wont be expected to give a reason to return to Thailand when applying for a Fiancee visa.

A decision on any visa in the majority of cases is given within 4 days of application except if your G/F is called for an interview. In that case there will then be a wait for the interview depending on the current waiting list which could be several weeks.

It's difficult to visualise your situation as you say you have only known each other 5 months but have already applied for 3 visitor visas. You also don't say how long she has already spent in UK.

She was in England from may 07 to november 07 on the last one, before that she had one for france. We met in july 07 and she returned in november 07. With hindsight it was wrong to apply for another visit visa but we didn't know as much about visas as we do now. We're just worried now that it may have damaged our chances for the fiancee visa.

Thanks, we're just compiling everything now. We've been to expect anything betweeen 10 days and 13 weeks depending on how busy they are.

Well that explains a lot, she would not be expected to spend more than 6 months in any 12 as a visitor in UK, however that shouldn't affect your application for a Fiancee visa unless she upset the ECO's by staying longer than she promised when she applied for the visitor visa.

I think the current waiting list for interview is 6 - 8 weeks if she is called for interview.
