Hi,

I was hoping someone can give me some options.

My gf has just arrived in Australia on her second 3 month tourist visa. When the application was submitted we asked for a 12 month m/e but were granted another 3 month single entry. The difference this time is that the - No further stay - condition is not on the visa.

As we plan a future together and all is great are we able to apply for a Prospective marriage visa whilst she is here on this tourist visa and if not are we able to apply for an extension on this visa so she can spend Christmas in Aus.

If anyone can advise as to what my extension options are that would be great.

First have a good look at the visa as it maybe a multi entry stay of no longer than 3 months...

If as you say it doesnt have a "no further stay" clause.....you can get extensions and possibly even the prospective or temp res visas....

contact your immi office to clarify before making any further applications.

Thanks for that...I came through Perth airport with her and they stamped no further travel on the visa....its a single entry.

I will contact Perth immi and go from there.

Thanks again as over the years I have read your advice on other threads and it has been very helpful.

Thanks for that...I came through Perth airport with her and they stamped no further travel on the visa....its a single entry.

Although it was nearly ten years ago now, it may be still relevant.

My girlfriend at the time had already applied for the prospective spouse visa from Thailand to Australia. After we learnt it could take up to a year for the prospective spouse visa approval we applied for a tourist visa which was approved (despite all the advice we received that it would be impossible). There was no 'No Further stay' clause on the visa so she was able to extend the tourist visa for an extra two months while here in Australia. So it seemed that provided 'No further stay' was not stamped in the visa, extensions were possible.

My advice for someone in your situation is instead of applying for off shore spouse visas which take a long time get your girlfriend a student visa for more than one year if possible. Although she will need to attend classes, at least she would be able to work up to 20 hours per week and you can be with each other. Once you have been living together here in Australia for more than a year you can apply on shore for a spouse (even de-facto) visa which only takes a few months. Much easier than living apart and trying to communicate back and forth with the embassy in Bangkok.

my now wife applied for prospective marriage visa in bangkok (jun 07) and it took 5 working days for it to be approved, she didn't require an interview just an informal chat with the officer.

she was then able to come to australia, work or study without any restrictions. she ended up studying by choice.

dcm unless your gf's main interest in studying in australia , i wouldn't bother going down the student visa route.

once you speak to imm you will know what your options are and make a move towards your goal (her marginating to aus).

if you did end up going through the prospective marriage visa route, just put an effort into supplying all the required documents, and you'll have no issues getting the visa approved.

Dont need to contact Immi......it is a 3 month single entry ....you will not be able to extend or get a further visa unless there are extenuating circumstances....

She will need to return to Thailand to apply for the spouse visa....prospective or otherwise.
