Our original application was refused in August and the Embassy convinced my GF to re-apply as this was quicker than appealing...of course I had to pay again :-( but boy 2 weeks! we waited nearly 12 for the refusal. paulyturner Posted November 12, 2009 Share Posted November 12, 2009 Aom and mines case is a little more complex, however, my god i'm getting anxious and im only 3 weeks into the wait! it's great that the waiting times are coming down, just pray that my agony isnt prolonged too much, Aom seems to thinks its still likely to be 3 months before a decision but im remaining hopeful, to give an insight i met her in uk and she had to go home, we have obviously told all to home office on the application and have been advised by my lawyer its 50/50 as to whether the visa is given, rising to 90% upon appeal but hey ho, we're prepared for this, its still really heartening to see so many success stories on here. Basically a little question for those in the know, having proven we have been together well over 2 years now, and having a son and being married, I know what i'm told by my lawyer but in your guys experience, do this things hold much weight on application decisions for spousal visas? obivously i know being married means i can apply for a spousal visa lol, but im more erring on the side of having a son togeteher with a dual nationality and 2 passports. Any advice is welcome guys cheers Hey Paul, Sounds fine on the face of it......criteria are your income (to be able to support all in your household), Your History (proof of being together for about 2 years), your accommodation (Room for children each, you and your partner, plus one communial room, or sitting room). You need to furnish proof dated photos etc and joint name bills or bills for her at your address and such like. You're better off browsing the Home Office website...There's a lot of info on there, and on here of course. I'm self employed and that's where I went wrong on our first application. You really can't add too much info about your job/financial circumstances. This time I went out and got signed letters from all my customers confirming I work for them, got a letter from my accountant confirming my projected income, tax records, gave full details of current and forthcoming work, got letters from friends and family and gave bank statements for the last 3 years. During that time I was classed as UK nonresident so no tax paid and I was technically a tourist in Thailand. Difference is that I am self employed but I failed to show enough evidence of that fact. If you are currently unemployed, you should ideally get a job offer in writing that states your salary and start date. Either that or I guess you need to show significant savings in you bank to tie you over while you find a job. Bottom line is, you need to show that you can provide complete finacial support and proper accomodation for your family. We used an Agent this time round and am glad we did. Basically, to simplify things to start with, you'll need to show that you have a genuine relationship, that you have proof of adequate accommodation in the UK and that you have adequate funds/income to support your wife without recourse to public funds. For accommodation you don't even have to own/rent your own home, you can return and live with relatives/friends but there must be enough room in the house with everybody having their own bedrooms. For income this can be made up of either a salary, savings, or a combination of both. Some people have been able to show that they have a 'secure' job offer and this has been acceptable but generally if you don't have a job you must show you have sufficient savings. A promise that you'll get a job after you arrive in the UK is not enough. As for the amount of money you need per week/month, although there is no hard and fast figure, it's generally accepted that the minimum requirements for disposable income (after rent/mortgage etc.) are the same as you would get on income support. paulyturner Posted November 13, 2009 Share Posted November 13, 2009 Fluid, seems like we are EXACTLY alike then! am in constant touch with her, on the app site constantly and of course come and go from here, i notice on the tracking site it constantly says 'your application was sent to the embassy on the 22nd october' or words to that effect, so what did your says when that kind of statement changed? On another note, i submitted 3 months worth of wage slips and had my boss show exactly the same amounts on them as goes in my bank account, i guess its about proving a regular income so can certainly prove that, Also as i recall i sent in my CV showing job experience and described in detail what i do for a living, I'm an insurance broker and so explained how my pay is structured and also the kind of qualifications i have, i dunno if this helps at all but, if you can show your a proffessional in your field maybe it can add a little gravity to your application. Finally and I dont know if others have done this, but the consultant i used over here wrote an excellent letter to the embassy that went with my app, negating many grounds for refusal and refering to the particular sections in law, if this works then brill and I will happily recommend her services to ppl on here, she is based in sheffield. I just came round from the longest hangover ever! Ho Hum The Agency are now paid, (Not cheap, but worth every penny!!) Flights been booked for the 4th December and boxes are being loaded onto a ship as we speak. Wow I'm wasn't ready for the expense! Thought we had a few more weeks to wait at least. I hope this means that waits for 'straight forward' settlement visas will remain at respectable levels. The waiting is the worse thing and several months is really not acceptable! Weathers not that wonderful so first trip should be to get warm clothes and an umbrella!! Our central heating is on so high I can hardly breath!! I'm back in Thailand submitting my application first week of Janauary - does anyone now if this is a quiet period? As in not to many student application and others etc. And a few questions. I need to subject a certified copy of my passport, I'm in the UK; is it OK to knock on my local police officers door to sign rather than pay a solicitor? If, so how does the Police officer go about it? I have a direct debit to my Credit Card of 20 pounds a month, do I need to show in the VISA documentation my credit card statement - it's rather higher than I like and I'd rather not. Other than that my current account is healthy and I regulary save after pay 200 pound a week after expenses. I also have an extremely secure job backed up by a letter from my employer. should be Ok right? Before moving back to the UK in July this year I lived and worked in Thailand for 2 and a half years with my Wife and child who is 21 months old now and I have evidence of living there. Back here in the UK I have free accomodation from my parents with enough room for wife, child & I. I can prove all this; do you think i have a strong case? I shouldn't have to prove no recourse to public funds for him or even put him on dependents travelling with my thai wife on the visa application form should I? He could be simply travelling with me. Of course all our proof of relationship evidence such as photos include him with us. I have accomodation for him and funds. How do I go about this? 7by7 Posted November 18, 2009 Share Posted November 18, 2009 Each page of the photocopy of the passport should be signed "I certify that this is a true copy of passport number......" Anyone can do this, even you yourself, although a solicitor or police officers signature would carry more weight if there was any reason to doubt the copies. You should include copies of the blank pages, to show that they are blank. There is no need to submit your credit card statement, your bank statements and pay slips will show your disposable income. Having debts is not a problem, as long as you show that any debts are being serviced. Living with your parents should not be a problem, but they should write a letter of invitation in which they describe the property to show that there is at least one room available for the exclusive use of you and your wife and, as your child is over 1 years old, another for the child. They should include proof of ownership if they own, or a landlord's letter confirming that you and your family can live there if they rent. See Maintenance and accommodation As your son is a British citizen he obviously does not need a visa and no immigration controls or conditions will apply to him. Now if we hadn't put down 12th December as date of travel (thinking we would be lucky to get the application processed this side of xmas), they would be here by now... anyway, i'm not so bothered, we got it and that's the main thing and it will be a happy xmas. paulyturner Posted November 18, 2009 Share Posted November 18, 2009 see...now im worried, as althought its been less than 4 weeks, other people are getting there decisions granted, whilst im really happy for anyone who gets throught the system and can be with there loved ones, i so cant help but worry, my missus is still adamant that because our case is a little complex thats its going to be a 3 month wait..do we know if its generally the case for cases that do have complications to take that much longer? complication in this instance is that i met her in uk and she took a voluntary departure to leave the uk 2 yrs ago almost. but also guys and seriously I am so happy for people who are getting there wishes come true. everyone deserves there true shot at happiness, just scary as hel_l is the uncertainty eh?
