Hi all.

I have been reading your questions and inputs for a while, so here is curly one for you.

I plan to marry a Mayanmar lady who is living in Thailand with only a Mayanmar ID.

She has been in Thailand for a number of years with her three daughters

Her husband died some years ago, he was also Mayanmar.

Is there any way this lady can apply for and get Thai residency status?

If she were to marry a Thai man by contract while she is living with me, how long after the marriage would she gain Thai residency. If she divorces the Thai man, would she retain her Thai residency?

If I remember correctly Burmese Citizens are not allowed to marry anyone from another country. She would have problems getting the required documentation from her country.

If she is here with only and ID issued by the Myanmar goverment then she is here illegaly. There are many here in same situation but they have registered with the Thai goverment.

Any foreigner has to have an affirmation to marry from their embassy or consulate to get married legally to anybody including a Thai. It is very difficult to get one from the Myanmar embassy. A member has reported trying to get one and was told it would cost 40,000 baht to get it by an official at the embassy.

Could you please expand on the above comment re affirmation to marry.

If a lady from the UK for example wanted to marry a Thai man she would have to get an affirmation to marry from the UK.

Similar to what I had to get to marry my wife from my embassy.

3. If an alien is registering to be married to a Thai citizen or another alien, he or she is required to submit following documents.

A copy of their passport.

A Letter of Certification, issued by an Embassy or Consulate or a Government Organization from their country, regarding the marital status of the person. The Letter must be translated, then certified by the relevant Ministry of Foreign Affairs.

What you suggest here is illegal and immigration police will check if there is a real marriage or only one on paper. They might even interview the neighbours.

As we do not discuse illegal activities please refrain from discussing this option again and focus on the legal options.

hey dude,

i'm in the same boat as you. i've been trying to find ways of getting married for at least 6 months, and the only way is to pay shit loads of money to some asshol_e wife of a burmese general in an office in silom. it's also dangerous because they keep in regular contact with your spouse's relatives, so if you do something 'anti-government' in another country (i.e. protest, or meet with protest leaders) they will fuc_k-up her family's lives. don't do that.

besides, you did say that your lady may be here illegally - at least without a passport (which means she won't be able to pay the bribe in thailand anyway, as they use the passport no. in the app.). anyway, burmese people have told us that if you have your myanmar id card (hmat pone tin) then she can just go back across the border and apply for a passport in yangon (takes a few months, and between US$50-150). once she's got the passport she can fly to bkk, providing she shows the embassy in yangon $500, and perhaps a copy of your bank statements (you can fake these, as they have no idea about internet banking in burma, and have no inclination of checking). if you went with her that would be perfect.

now if you want to get married i'm afraid the best thing is to take her to your own country, or somewhere else in asia (singapore or hk), and get married there (though the latter options require being in the country for about 2 weeks prior). my advice would be this - get her a thai tourist visa, get married and come back here. when you get back to thailand she can stay on your visa, which is much less hassle. i'd also say that if you wanted to go back to your country, it would be easier to apply for a visa after being married in your home country (as you can attach photos of you guys meeting friends and family, and she can say how much she likes the place, and wants to live there with you, etc, etc).

best of luck with it all. pm if you need any more details. your lady can also chat with mine. it's a bitch of a situation, and i've been very stressed and worried about it for a long time. but, finally, there is light at the end of the tunnel.... touch wood.

in short, marriage will cost you - and as i don't like large sums of money going to complete fuc_kwits who will do anything to suck money out of us, i'd rather pay an airline company and have a holiday in a nicer country (which, for me going back to australia, is much cheaper anyway).

edit: when i say she can stay on your visa, i'm assuming your on a work permit with an extension of stay. if not then she'll just have to extend her tourist visa regularly like you do.

The fact that your lady only has her Myanmar ID means that she is an illegal alien. Those Burmese in Thailand semi-legally have been given ID cards that signify their status, for example; refugee, hilltribe, migrant worker etc. There is virtually zero chance of her getting Thai residency without being registered in the Thai system. Even then, the Thai bureaucracy is not favorably inclined to issue residency documents to Burmese illegals.

What are your plans for your lady and her 3 children? If you plan to take her to your home country then they will need passports, another imposable task for Burmese living in Thailand. If not, then perhaps a traditional Buddhist wedding would suffice, and forgo the registration.

franc1066 as a matter of interest what nationality are you, if you are not Thai can you make application with your own country for a spouse visa / travel document under some type of refuge status. (just a thought)
