Can Thai Wife Take British Born Baby Home For Good

I have a senario as follows.

Me and my wife married in the UK some 3 years ago, we recently have had a baby who was born and registered in the UK.

I am being threatened by my wife that she will return to Thailand with the baby and not return. I believe applications are being made for a british passport and a Thai passport.

My question is if they did go to Thailand is there any Thai law to stop this, is it legal and would i have to have signed or granted anything to make it legal.

My desire is to let her just visit which is only fair but i do not want a situation that once there it is perfectly legal for the baby to stay without my consent.

If you give her permission to take the baby to Thailand there is no law or international convention to prevent her from staying with the child & there will be little you can legally do about it. The child can only get a Thai passport & thai birth certificates if both parents sign & attend an appointment at the Thai embassy in London, unless she can show she has sole custody.

If the relationship has broken down & you do not wish for your child to be taken overseas then I suggest contacting a solicitor & putting some kind of official court agreement in place.
