Marriage In Thailand Or In The Usa

Featured Replies

I have done some searching on this forum for information regarding marriage in Thailand vs. the USA. I was unsuccessful in getting any pertinent information back.

Does anyone have, or can point me in the right direction to, information regarding this subject?

I live in Minnesota and have been married and divorced there so I am a little familiar with the process with the exception of the "pre-nuptial agreement" stuff. I know the various states in the US have varying rules but what about Thailand? Is it pretty straight forward regarding assets before, during and after a marriage? If, and I repeat, If, a divorce is necessary would it be better to have been married in Thailand? If any members of this forum have experience regarding this topic I would appreciate any information you can provide.

If you have a legal Thai marriage (registered properly with the Ampur) then you are recognized as married by the US Government as well. Larger married tax deductions, etc. apply.

If there is a divorce and your Thai wife is sophisicated enough to hire a US attorney, she could take you to the cleaners. But this is unlikely unless your lady is a college graduate, with good English skills or has a relative at this level to advise her.

However the community property laws of Thailand would apply.

So document what you have coming into the marriage and it'll be safe.

Some say prenups are worthless and can be thrown out, others say it is a must. Up to you to decide that one.

I'm not sure I agree with the statement that community property laws of Thailand apply. I suspect it matters where you live and divorce more than where you got married.

if it only matters where one live when filing for divorce then with good planning move to LOS before a divorce may be wise?

Why do you say this ??

Thailand observes community property principles AFAIK.

If she is smart enough to get an attorney to get her into court, who do you think a judge is going to side with ? ..... a well off Farang or a poor, crying little Thai girl who is getting dumped ??
