Communication with the Developer in relation to a warranty claim in respect the condo where I live has produced a zero result The building is just over 3 1/2 years old . Claims started when the building was less than a year old The developer claims that it is his sub-contractor that is at fault -and that this sub contractor must make good the damage. For the past 2 years he claims he has been pursuing this sub -contractor through the courts. He further claims that this is the legal process in Thailand. We are not amused. The obvious next step is to sue. I need advise from parties that have attempted this approach and whether the effort produced positive or negative results. The developer does not deny that there is a problem. The claim is around the 350,000 baht mark

Your contract is with the developer, not his subcontractor. The developer is responsible for his subcontractors work and if his subcontractor cannot carry out the maintenance / repairs then the developer has to find someone else to do it at no cost to you.

Sorry to Hijack, but does this pertain to all condominiums or just yours? Also what items or things are covered in such a warranty?

If your developer has such a train of thoughts, he is not one of the big boys...:lol:

Gather evidence for your case and sue the developer, and give notice with a one month expiry date that you will employ your own contractor to get the job done if he is not doing it.
