Staying In Thailand When Married...What Happens If Divorced?

In regards to Visa entitlements, I'm just wondering what happens if you are married to a Thai person and then the marriage breaks down. Do you loose all entitlements you had when married?

If married with no children and then you divorce, then how can you apply for a Non Immigrant based on marriage?

Yes you lose everything, visa runs from now on or retirement visa depending on age, or B visa for work.

or ED Visas would do it as well....

Neither at present, I am currently married to a Thai lady and was just curious where I stood if I was to move to Thailand and then down the track things didn't work out and we got divorced. Was wondering how hard it would be to stay there.

So what visa do you currently have? If you changed and got an extension from Immigration here, then upon divorce you would have to leave, but if you got a Visa from KL or another place outside of Thailand (multi entry of course) then who would be the wiser it you got a divorce during the validity of the Visa/

once you get the VISA ( for marriage ), the extension of stay need to be renewed per year, you and your wife go to Immigration together. change of marriage status of course affect this yearly renewal.

VISA run is another popular solution. but you can stay not more than 6 months in a year. not sure how Immigration control this.

I currently don't have a visa for Thailand. I am currently living in Australia but looking at what would happen if we were to move to Thailand.

So if I requested the multiple entry visa from Australia and moved to Thailand... if I was to get divorced, then I should still be able to stay in Thailand by doing the visa run by crossing one of Thailand's borders?

I believe you want to come here and divorce her.

At present I have no plans of getting a divorce, just looking at what situation I would be in if I was to pack my bags and moved to Thailand with my wife. Then if things went pear shaped and we got divorced, what would be the best/recommended way stay in Thailand long term.

So get a visa and dont extend it inside the kingdom with marriage as a reason.

So would it be best to just get a tourist visa then renew it by doing the border run every 30 days?

Believe that rule has now gone no restriction.

I don't know where you guys get this information about only staying 6 months. As maprao says, that rule is no longer in force and even when it was, it never had anything to do with people entering Thailand with a visa!

First choice, apply for a one year multiple entry Non-immigrant "O" Visa. Each time you enter Thailand you will be stamped permitted to stay 90 days, even if entering just before the visa expiration date. You will have to exit every 90 days, but by using that method you can stay almost 15 months, even if divorced within that period. If you apply for the one year "Extension of Stay" based on marriage, you would have to leave upon divorce, and apply for another visa of some type.

Second choice, a Tourist Visa allows an entry of 60 days and the stay can be extended by 30 days for 1900 Baht at an immigration office. You can apply for a double entry in your home country, Laos, or Cambodia that would cover about 6 months. Tourist Visas are obtained at Consulates outside of Thailand.

Also, consider the Education Visa and extensions for longer periods of stay.

Not good for long term, but you can also make "Visa Exempt" entries, 30 days if entering by air, 15 days if entering at a land border crossing point.

Don t know if they have the Investors Visas again, back then it was 3.Million Baht min.Investment in Thailand (Condo for example) and you could have unlimited Visas...

But I heard they stopped it about 2. Years ago but then they did it again.... Not sure whats up to date.

No kids at present, but I wonder if this would only be an option until the child gets to a certain age.

The Investment Visa sounds interesting, the idea of unlimited visa's would be a lot less hassle.

"must have been held in the Kingdom for at least 3 years" ...Wonder if you lose the visa if you sell the property or withdraw the money from the Term Savings account after 3 years

Any extension is lost if the reason for that extension no longer exists. So yes, if you sell the condo or withdraw the money from the account you lose the extension - just as if you are on a marriage extension and get divorced.
