Maximum fine for overstay is 20,000 baht however if the period involved is over a certain number of years one can be jailed. Personally know of several cases here in Pattaya. Suggest you check this information at an Immigration Office. Long overstays are treated very seriously now.

I arrange deportations on a regular basis.

The rule is if you are caught one day overstay you will be detained at the IDC suan Phlu (not a nice place) until you or someone else comes up with the funds to buy a ticket to your home country as per your passport.

You are then taken to court where you are fined 3,500 baht for overstaying then escorted onto the plane where your passport is handed to the cabin crew not to be returned until you land at final destination.

I had one guy caught with 3 day overstay wait three months as none of his family would fork out for a ticket. I had to pass the hat around on facebook. Thailand never pays for your ticket home even it takes 10 years in IDC.

If you go to an immigration exit point then the max fine is 20,000 with an overstay stamp.

It has been know to happen that too many overstay stamps will attract a 5 year blacklist.

Others have been deported home and returned two days later no problems.

It is up to the discretion of the officer.

The correct procedure for the missing TM 6 is to report it lost to police and take police report to immigration and get a new one issued with your correct dates on it.

If I ever get caught with a one day overstay please stay away from me !

Scaremongering is rarely of assistance !

Agreed. This looks like total bullshit.

Fill out a new one and give it to them. There normally are some on counter before immigration.

Hope you have 20,000 baht to pay your fine.

Wrong....The maximum fine is 5.000 THB not matters time.

please don't confuse or mislead other when you are not sure. i was on visa run to laos last week when i saw the notice at the immigration indicate fine not more than 20'000 . i have even talk to one of the guy that pay the fine.

for 1 day overstay is 500 baht & adding on depending on how many day you have overstay. but the fine will not EXCEED 20'000 BAHT

every hotel asks to see your passport and they then check your visa, so if you are on overstay you cant stay at any guesthouse or hotel. if you are the lease holder elsewhere similar i guess. want to be on good relations with your GF all the time i guess if you are staying in her room. think they hand out fines for the thai counterpart too?.

I know a story of a guy who did not pay his hotel bill. He got sentenced 1 month for that. And another 2 month for overstaying his visa. He only got out once he paid his outstanding bills.

where is the hotel that will let you stay even 1 day without paying in advance? 12 o'clock sharp they will be knocking on you door if you havent paid. then they turn off the electricity and water.

I lost mine once and I had to get a report from the Police station to take to Immigration, no big drama but not sure what would happen if I turned up at a Border/Airport without one

I had my passport stolen I tried to get out on my UK one but no I had to have NZ one. They were not interested in departure card just needed copy entry stamp in on my new NZ passport. I went back with my new passport and they put copy stamp in and away I went. Did this at BKK airport.

I'd assume he's talking about Pattaya guesthouses. Have stayed at numerous guesthouses in many parts of Thailand over the last 9 years. The one and only place I've ever had to pay in advance was at a guesthouse in Pattaya. Seems the owners in that city have special experiences with their clients since they feel the need to deviate from the norm.

I started this post and her is what happened:

I went back to the border, told them i didn't have the departure/arrival slip. They gave me a new one to fill out. Then I went back to the Overstay window, where the guy was not happy after he calculated how many days I was over. He said

"I blacklist you. You no come back to Thailand."

Whereupon I said ""oh please don't do that! You are gonna blacklist me??"

he said "I don't know."

This went on a few times while he was counting the 20,000 fine payment that I had handed over to him, where he kept saying "I blacklist you." and when I said "You're gonna blacklist me?!?!?", he'd say "I don't know."

Finally he said he would blacklist me IF HE SAW ME AGAIN. to which I thanked him profusely and went on through.

I wasn't able to make to the Thai embassy before 11:30 so I had to wait till the next day. The next day as I was waiting an old farang man at the front of the counter fainted. After about ten minutes his Thai wife ( who looked about as old as he was) started crying and screaming. No doctors came after another ten minutes, and some big black marine looking dude finally picked him up and carried him out. There were no ambulance sounds, apparently they had to put him in a tuk tuk and send him off. I guess maybe a half hour or more later his Thai wife came back and said he had died. Apparently he had a heart attack. The old Thai woman was crying....she had lost her husband.

When I got to the counter (the same one he dropped in front of) the guy told me I didnt have enough pages in my passport. I had two left, he said that wasn't enough. I had to go to the American embassy to put new pages in, hoping I could get back in time. When I got there they told me they couldn't take me until tomorrow. And that it would cost $85. I had budgeted my trip down to the Kip (which NEVER NEVER works when traveling) so now I didn't have enough for the visa. Today I got the pages put in and returned to Thailand with a two week stamp, allot of relief after a year and a half Overstay, and just happy to be alive.

Thanks everyone for all the helpful advice.

What

I don't believe that a immigration officer can blacklist somebody on his own.

This has to be done via the court system and will be only possible done for serious crimes (Narcotic, Rape etc) and not for overstay.

Please correct me if i'm wrong.

Posted

An immigration officer cannot decide that on his own, it goes higher up in the chain of command and you have the right to appeal at very high level. But not through the courts.

Thanks for the update, But the court can also blacklist people. ( is this correct )

Posted

I'm not sure a court can blacklist you. Normally you are blacklisted as the result of having committed a crime, not be a judge declaring you are blacklisted as an extra punishment. The convistion itself is according to the immirgation act grounds to be removed from Thailand or denied entry. (Not all convictions lead to expulsion, there are exemptions) A special court decision would not be needed.

The immigration act suggestes that the power rests with the minister of interior/immmigration commission.

I also find that they are pretty happy to give late check out of 2pm if the room isnt already booked as well just a quick call to reception

Probably because the places you stay don't follow the rules on reporting who is saying in their estabishment and work on cash basis only ?

Nice attempt at a slur, but I also have stayed at hundreds of hotels never been refused because of no passport.

My passport is in a safe and i rarely have it with me in Thailand.

Driving licence, credit card or money is normally enough.

No slur intended, just stating the fact that that's the way many places work. I do prefer to carry mine and have been asked for it in most hotels I stay in. I've also been asked for it on the street in BKK and get great pleasure in showing it and the visa to the cop just to see the look that shows he's unhappy because he's not going to get any cash.

Like GirlDrinkDrunk I only rarely carry my passport. (although I do have a reduced size, laminated copy of the data page/extension of stay in my wallet)

My Thai driving licence provides all the ID necessary including my address and passport number.

20,000 baht when departing Thailand or you can go and pay at your local immigration if you are picked up by the police it could mean a few days in the slammer best to pay up asap then you can start a new visa I know of 1 guy with 17 years overstay trouble is if he ever gets caught he would not have the funds to pay for it because he lives like a hermit he told me his daily diet was rice and a juicy snake when he could get one every one to their own he is no trouble and he has known the local bobbies for years think he will die here

A couple of local Expat friends who have been here decades, talk of a foreigner who overstayed 40 years and died here. Local police knew him well and never gave him any trouble.

for god's sake, sometime use your brain, if a normal officer, or a policeman can blacklist a foreigner,

it would have been actually one of the biggest scam, extortion made on expat.

Hey you you farang, i dont like your shoe, you give 10,000 baht or i will blacklist you cheesy.gif

All these story about blacklist are just made up story by some lunatic foreigners...

This argument comes up on TV from time to time. I've come to the conclusion that the people that always carry their passports don't know whether you can check in to a hotel without one because they have never tried. Those that don't routinely carry their passports with them know for a fact that it is extremely unlikely that a potential guest would be refused at a hotel for that reason alone.

It is true that reception will often ask for your passport. I guess that is why many people seem convinced that you need it.

Hotels are required to register their guest and inform immigration, by law.

Some hotels will rather use your Thai partner name to register, most hotels in Chiang Mai for example will do this, but in many places immigration does not accept that and they issue fines for failing to report.

That not every hotel doesn't want to see your passport doesn't mean it is legal.
