My wife is currently living and working here in the UK with myself on ILR. We are now ready for her to apply for UK citizenship as she has been here around 3 years. She obviously had to pass the LIT test at the start of this year to get ILR but what other credentials will she need to obtain before she can apply for citizenship. We are thinking of applying around May next year as our first child is due April time. Any help would be great. Kind regards

Firstly, since 28th October the LitUK test alone is no longer sufficient for ILR or naturalisation applications; applicants for both now need to have B1 of the CEFR or the equivalent in English speaking and listening, too.

Your wife wont need to pass the LitUK test again, but she will need to get an acceptable English speaking and listening qualification.

The other requirements for naturalisation are:

  • aged 18 or over,
  • of sound mind,
  • of good character,
  • meet the residential requirement.

The residential requirement if the applicant is the spouse or civil partner of a British citizen is:

  • physically present in the UK on the exact date three years prior to the Home Office receiving the application,
  • during the intervening three years have spent no more than 270 days in total out of the UK with no more than 90 days in the final year and
  • not been in breach of the immigration rules at any time during the three years.

N.B. If the British spouse or civil partner is a Crown servant in designated service overseas then the residential requirement does not have to be met.

Morning 7, she got her ILR on the old rules, so she passed LIT and did not need the English language requirement then, so does that mean she needs the English language requirement now for citizenship?

Yes, she needs to have passed the LitUK test and achieved at least B1 of the CEFR, or the equivalent, in English speaking and listening.

This is now the requirement for ILR as well.
