On 3 January 2014, The Adoption (Designation of Overseas Adoptions) Order 1973 (the 'designated list') will be revoked in England and Wales and replaced by The Adoption (Recognition of Overseas Adoptions) Order 2013.

Also on 3 January 2014 Scotland will revoke previous adoption laws and introduce the Adoption (Recognition of Overseas Adoptions) (Scotland) Regulations 2013 and the Adoption (Recognition of Overseas Adoptions) (Scotland) Amendment Regulations 2013 (the '2013 Scottish Regulations').

The countries named in the new 2013 Order and 2013 Scottish Regulations are different from the countries named in previous adoption laws. This means that recognition of domestic adoptions in some countries has now changed.

Do you know if this will be retrospective, or only count for adoptions in those countries which take place on or after 3/1/14?

How will it effect people in ulike's position; i.e. will it make it easier for her to obtain a settlement visa for her niece who she and her husband have adopted under Thai law and lives with them in Oman? (See this topic)

But as Thailand will be on the designated list from 3/1/14, how easy would it be for you to adopt her under Thai law?

Having said that, I feel an application under Para 297 is the way to go for you and, provided you can supply satisfactory evidence, should be successful.

Happy new year first!!!

Adopting in Thailand is a nightmare for adopters Thai and foreign. It could be 24 months if we are lucky.

Our application for the UK visa is nearly done. Just waiting documents from Thailand from the hospital to show her Grandma;s poor health (and why I was awarded custody).

I quite agree and gave up several years ago. I've had my stepson from the age of three and he is now over 18 but never legally adopted.

It's hard enough to progress through Thai bureaucracy but when you add to that UK Social Services and the issue of translations it's like a game of Chinese whispers. A lot of paperwork has to pass to and fro to Thailand from the UK before the child is adopted legally.

I understand the bureaucratic nightmare in the UK means children grow up in care while pen pushers just move bits of paper not realising they are dealing with someone's life.
