EEA permit advice please. child has recently joined mum in uk.

Featured Replies

my wifes child has recently joined mother to reside in uk. 6 months resident stamped in passport. what do we do before childs stamp expires ? wifes permanent residence is currently pending with home office. wife has lived and worked now in uk for 6 years.

do we apply to ukba before 6 months exp date is up ? if my wife is granted PR which we uspect will definately be granted what happens , does the child automatically get PR also ?

confused.

thankyou

All EEA Family Permits are initially valid for 6 months.

However, the holder will not have overstayed if they remain in the UK beyond this time; provided they continue to fall under the regulations.

However, it is advisable to obtain a residence card as this is proof of their right to live in the UK.

I am not sure about when the child will be eligible for PR. Had s/he come with her/his mother then s/he could have, of course, applied at the same time and on the same form as her. But as s/he came nearly 6 years later, I'm not sure.

I'll see what I can find out, unless someone who knows the answer posts first.
