Talks ordered on Kim Dotcom assets freeze

AUCKLAND: -- Music and movie giants have joined forces to freeze Kim Dotcom's assets, but they'll have to negotiate conditions first.


Lawyers appeared at the High Court in Auckland on Monday on behalf of four music industry companies and six Hollywood film studios seeking to have Dotcom's assets frozen ahead of their claim against him.

The record labels are understood to be Warner Music, UMG Recordings, Sony Music and Capitol Records, while the film companies are 20th Century Fox, Disney, Paramount, Universal, Columbia Pictures and Warner Brothers.

The companies say the now defunct file sharing website Megaupload and its key operators, including Dotcom, facilitated, encouraged and profited from massive copyright infringement and want Dotcom's New Zealand assets to remain frozen while their case is under way.

Every defendant is entitled to legal counsel, and apparently Mr. Dotcom has decided to go for the most expensive, controversial, and high profile counsel money can buy. Good luck to him.

He should have the best lawyers he can find. Remember, this kind of asset freeze "ahead of any claim against him" means his assets and/or bank accounts are frozen before he even gets to hear any claims or charges against him, before there is any discovery, and before there is any trial. In other words, no Due Process of any kind.

It's an extra-ordinary remedy. Just barely legal. It should only be applied, IMHO, in the most extreme cases, and anybody in Kim's position should be represented by the best legal counsel he can find or afford.

Think of how you would feel if someday a team of lawyers convinced a judge to freeze your bank accounts before they even filed any charges or claims against you. It would kind of smart, no?

The bully boys of the world today, the Americans also stole several years of my lifes photo's which I paid to store on this site yet they refuse to return my property so I for one wish this man ever success in beating the people who really run America as in the big corporations

America seems intent in turning the whole world against it for some reason or another just lately

As confirmed by President Obama recently the USA is exceptional so the usual laws don't apply to them.

How many times do you have to do something which is 'extra ordinary' before it becomes ordinary ?

If the USA wants it, the USA gets it and in doing so they will coerce foreign governments to do their dirty work on their behalf as we have seen in the outrageous Kim Dotcom case and other cases a little closer to home - Viktor Bout's entrapment and subsequent extradition from Bangkok for example.

They are clearly attempting to freeze all of DotCom's assets to prevent him from funding a proper defence when he is eventually extradited due to the 'rolling over' of the NZ Gov who are actively working against him on behalf of the USG.
