Confused over my Visa & Extension and what I sould seek to stay on expiry

Featured Replies

I got an Extension to my Retirement Visa in November 2014.They charged me 2000THB. Now I have to do 90 Day Reports which I was not doing before.1. Have they Changed my Visa?

I mentioned that I need to leave Thailand from time to time, so I got a Multiple Re-Entry Permit also.

2. If I leave and re-enter before the Extension is up will I get another 1 year?

3. Failing that can I go along to Immigration and get another 1 Year Extension, showing that I have the required seasoned Funds?

Sorry I have had a look through the Forum and I am still not absolutely sure of my position.

1) your visa has expired, you are now staying on a permission/extension of stay (for 1 year?).

Technically the re-entry permit is a visa (allowance to enter the country).

If you like: the re-entry permit is your new visa.

2) no, with the re-entry permit you will just get another stamp at the border checkpoint allowing to stay until the original date resulting from 1)

3) yes, if you reenter after the date allowed by 1) you start over (a bit more complicated story)

Each entry to the country will start a new 90 day cycle.

So depending on your travel plans, you might have to do one or more 90 day reports or not.

Thanks for the reply KhunBENQ.

Yes I have a one year extension.

OK would it be correct If applied at Samui Immigration just before the one year is up, to gain a new one year Extension?

I guess I would like to continue making 90 Day reports and not have to seek a new Visa in Penang as I had before.

All correct.

Apply for a new extension of stay before the year is over (basically with only the well known precondition of seasoned money or income statement) .

You can apply up to one month before the extension expires.

Do 90 day reports at Samui. No need to apply for new visa at Penang (no need to leave the country, except you desire so).

smile.png Thank you so much KhunBENQ.

Thats a load off my mind.

One more thing comes to mind.

When should the 90 day reports be made? I have the paper showing the date from Samui Immigration (90 Days) but does travelling efect the need to make reports?

Samui Immigration (90 Days) but does travelling efect the need to make reports?

Yes, as said. If you leave the country before the 90 day due date the date on the slip it is obsolete.

When you enter the country with your re-entry permit, than that is day 1 of a new 90 day cycle.

Its on you to calculate the new date for the 90 day report (date of entry plus 89 days).

There is a grace period for the report of 7 days before and 15 days after the nominal date.

For entering the country with the re-entry permit the usual tipps apply:

write the number of the re-entry permit to the departure card

point to the re-entry permit in your passport

check the stamp (date allowed by 1), end of one year extension )

100% Clear on that now KhunBENQ.

Many thanks for sharing your knowledge.

Truely marvelous having some idea now.

A correction to the grace period. You can report up to 7 days after the 90 day date without a fine. You can make the report 15 day prior to the 90 day date but the new reporting date will be 90 days from the date immigration accepts your report. You will receive a receipt with the new reporting date.

Correct. The error came to my mind ofter switch off.

15 days before, 7 days after.

biggrin.png gdaya folks,

came 1998 to bkk got married under my double name from my first marriage in europe, stayed until 1999 in bkk on mutiple non o.

wife joined me 2000 in europe. 2007 changed my name to my original family one obtained a certificate.

may 2014 back to thailand obtained marriage extension. had the name change certificate translated and certified in bkk foreign ministry.

my wife obtained khortor 2 current certified copy from the bkk amphure confirming the double name.

when filing the papers in joitiem, the officer would give me back the copies change of name certificate.

now two questions for the next 1 year extension :

do i need the change of name certificate again ??? also remains it valid after being duly stamped and signed by foreign ministry in 2014

does my wife need also a new khortor2 excerpt in 2015 ??

You will need all documents again.

The name change certificate should remain valid, the khor rhor 2 will require a new one from teh amphur to confirm you are still married. (You can get it at any amphur for 20 to 50 baht).

No idea what khor thor 2 is. If about name change no new one should be required.

All correct.

"You can apply up to one month before the extension expires."

Always a good idea since you don't want to leave it until the last minute in case you forget to bring something and have to go back or you're otherwise delayed.

You don't lose any days. The next year's extension is always added onto your current extension expiry date regardless of when you apply.

Just to clarify ... the 90 day report has nothing to do with your extension. Anyone in the country for 90 uninterrupted days must make a 90 day report to immigrations. If you go out and return (using the re-entry permit number on your arrival card) you can start a new 90 days count from the date you return before making the next report. You only need to report when you have remained in the country for 90 continuous days (you can go in 15 days early or 7 days after the actual 90 days without a problem).

The re-entry permit will expire when your extension expires, so you need to get a new one following every new annual extension of stay if you plan to travel out of the country. And of course you need a new one if you just get a single entry re-entry permit and you use it once.

KhunBENQ is a bit confused when he says your visa is expired, because Thailand visa's DO NOT have an expiry date.

They have an "enter by" date, but your stay has been extended so you are still here on that visa, it's your stay that's extended not the Visa, the visa did not need extending because IT NEVER EXPIRES, it's only your stay that expires and then you are after the "enter by" date.

That's why you need a re-entry permit, so you can effectively get back in without entering again, and hence your visa continues...

you had a visa which expired, before expiration you got an extension of stay for a year (commonly incorrectly referred to as a retirement visa) it is not a visa - it is an extension allowing you permission to stay because you qualified for the criteria

This one year extension allows you to stay in Thailand for one year, to comply with the rules you must report to your immigration every 90 days.

If you leave Thailand you must have a re-entry permit (which you have)

When you re-enter Thailand after leaving your 90 day report resets to a new 90 day period from date of entry stamp

when the one year extension expires you simply renew the extension and you are good for another year

I have a 1 year Retirement extension that expires in mid February.

Can I just go do a new 30 day extension at Chaengwattana and then leave the country and get a new visa once that expires?

The most you cna get is 7 days to leave the country. There is no 30 day extension on a non-immigrant visa.

Can I just go do a new 30 day extension at Chaengwattana and then leave the country and get a new visa once that expires?

The only extension you could get is 7 days.

What kind of visa do you want to get?

I was going to go to Laos and get a couple tourist visas. I've been on multiple Non-O's for many years because of my kids, but I got the visas in the US. I think I have one or two tourist visas from about 5-6 years ago in the passport.

Based on the children you can get a 60 day extension, if the children visit immirgaiton with you and show their birth certificate (ID if have) and their household book.

unless I missed something, why not just renew your retirement extension for another year - that's what everyone else does

I may return home soon and didn't want to move the funds here right now.

If you are the legal father of your children by way of marriage or legitimization of your parenthood you could get an extension based upon being their parent. Only 400k baht or 40k baht income would be needed.

You can get a 60 day extension to visit you children. They would have to go to immigration when you apply. You will need their birth certificate plus a copy and a copy of their house book registry.

Can I do a 60 day extension at the end of a tourist visa? I haven't been up to Laos for almost 20 years and would like to see Vientiane again.

How much is a double entry tourist visa, haven't done one in a while.

You can do it for your current extension. And you can also use it to extend a 60 day tourist visa entry.

A 2 entry tourist visa costs 2000 baht (1000 baht per entry).

The visa from Vientiane will only be valid for 3 months so you would lose you 2nd entry if you did a 60 day extension and stayed until it ended. Best do 30 days for the 1st one and the 60 day for the 2nd.

Sorry but you're the one who's confused. Visas expire and are never extended. The "use by" date means following that date you cannot use the visa to enter the country. After the "use by" date you'll need a re-entry permit or you'll lose your extension of stay and only be allowed in with a new visa or a visa exempt entry. Your expired visa will be dead and buried.

The only thing that can be extended is your permission to stay in the country. With few exceptions, visas are issued by embassies/consulates and permission to stay is granted only by immigrations. Two different ministries.

Immigrations may even allow you permission to stay without a visa (visa exempt entry), but having a visa does not allow you to be in Thailand unless you were given permission to stay by immigrations.

Visas and permissions/extensions to stay are two separate things and serve two different purposes.
