Thoughts? Should we hold our breath until then? Likelihood of change?

http://www.thaivisa.com/forum/topic/677797-update-on-home-office-appeal-against-spouse-minimum-income-judgment/

Thanks

Below from: http://britcits.blogspot.com/2015/07/mm-case.html

.. MM case, challenging the £18,600 threshold, but also exclusion of third party support, bizarre lump sum multiplier to make up salary shortfalls, rigidity in application of the rules and no allowance for Article 8 and s55 (best interest of children) by caseworkers, amongst other things...

8th July update:
Today we received confirmation that the MM case hearing will be from Wednesday 24th February to Friday 26th February in the Supreme Court.

Three days of hearing is welcomed, given there are four appellants and the volume of evidence to be submitted against these rules.

It is possible to go in and watch the hearing in person - and for those who are able to, this is strongly encouraged as it also shows the judges the public interest in the case and the people directly impacted.

For those who can't make it however (or simply wish to watch the hearing again), we understand the Supreme Court also puts out webcasts that will alllow the watching of the rules, certainly as a recording after the event, but possibly live as well.

More on this closer to the time though we hope 9th July 2016 will no longer need to be a protest against the family immigration rules.

Best page I've found so far, I can't see anything changing, anyone think there's a chance of change? : https://www.ein.org.uk/news/updated-house-commons-library-report-financial-minimum-income-requirement-partner-visas

In a 'news story' published on GOV.UK on 11 July, James Brokenshire, Immigration and Security Minister, welcomed the determination and defended the minimum income threshold: We welcome those who wish to make a life in the UK with their family, work hard and make a contribution, but family life must not be established in the UK at the taxpayer's expense and family migrants must be able to integrate. The minimum income threshold to sponsor family migrants is delivering these objectives and this judgment recognises the important public interest it serves.

So myself being Brit from birth in the UK, with family and friends... and they worry about me integrating, or just my wife? rolleyes.gif

Thoughts? Given in the linked to topic and at length in others.

Should we hold our breath until then? No.

Likelihood of change? Very slim.

Very slim. Thank you. I value your opinion 7by7.

My immediate problem is the 6 month rule - only after having the required income for 6 months can I apply for my wife. The time for acceptance of a spouse visa may be a month, it may be 3, 6...

It's a hard thing to leave your family behind, or gamble with visitor visas in the meantime.

A few politically incorrect tick boxes on the forms, and a fast lane would be logical.

In this day and age of databases, can they not tell how many generations of 'British' I am, my track record of benefit claims - (none), my ethnicity and *cough* religion etc.

Won't hold my breath. Cheers

This forum is about giving and receiving visa advice, not debating immigration politics. (Post removed)

I do apologise. I thought the Court hearing mentioned in the OP, regarding the £18,600 was exactly that, immigration politics.

To the OP.

Do not hold your breath waiting for this getting reduced. It is more than likely at some stage be raised. Or additional measures added.

If anyone cannot meet the financial requirements. There is the backdoor method of the Surrender & Sing route. I would suggest that you use this immediately, before it too, gets closed down.

Successive Governments over the years have lied about the size of the UK population and it needs to be curbed rapidly.

Carry out your own research. All will be revealed.

Seems like they are catching on and hopefully that dodgy door will be closed. http://www.telegraph.co.uk/news/uknews/immigration/11742020/New-immigration-figures-prompt-back-door-to-Britain-fears.html

Great points JockPie and RabC - I'm 25% lowlander too... Maybe that'll be the route in the future! 3 months in the south of France, I wish I had the $$$$ to try it.

A question if anyone could answer - would UK immigration object to stating the purpose of a 6 month visitor visa being to allow me to work, and that a spouse visa would be applied for after the required 6 months from Thailand?
