Koh Tao murder trial reconvenes in Koh Samui

Disturbing revelations in that report regards the alleged psychological & physical torture they suffered to extract the confessions. Surprise surprise no doctor available to inspect the bruises on Wei Phyo's face. Not surprising why the RTP refused on countless occasions to show up for the meetings with the Human Rights to explain the allegations. A sign of absolute GUILT

Zaw Lin and Wei Phyo, both immigrant workers from Myanmar, say they were told they would be burned; have parts of their bodies chopped off; be put in plastic bags and their bodies dumped at sea. They say that is why they continued to admit their guilt until an interview with human rights lawyers while they were on remand in Koh Samui prison. They also claim they were hit by police and the translator working for the police. The translator is also due to testify in court today.

Police on the mainland did say during the trial yesterday that they had called for a doctor to examine bruising on Wei Phyo’s face but “no doctor was available”.

Following his arrest and interrogation, Zaw Lin was taken to hospital by police officers complaining of bruising and chest pain. The medical director of the government hospital in Nathon, on Koh Samui, said he conducted a CT scan on the suspect and identified possible injury to his rib cartilage.

However when Doctor Chan Chai was asked in court how such an injury might be sustained, he said he didn’t know. He also said he had an injury to his wrists for which he also didn’t know the cause. http://www.eveningnews24.co.uk/mobile/news/thai_solicitor_says_burmese_man_admitted_murdering_hannah_witheridge_and_david_miller_1_4199587

may be the B2 know the cause. Have they been asked?

would be easy to show the CT scans to an independent doctor and ask what could have caused them

The police probably had hoped the doctor would not find any signs off violence - unfortunately somebody made a mistake and ordered a ct-scan

If it would really happen that they ask an independent doctor - the ct-scan pictures will be probably "used up"

So far, we are still hearing the testimony of the prosecution witnesses, remember. One wonders what revelations may be forthcoming next month when the defense gets their turn.

Yes, and wasn't it reported that there were around 60 witnesses for the prosecution? When will one take the stand and say something that will convince us that the B2 are guilty?

Andy Hall : The swabs from the 2 accused to ascertain with certainty their DNA profiles were taken in front of multiple witnesses in the Koh Samui court

I am happy about this, now we have at least true witnesses so nobody can think it will be faked again . Let's see if they match.

Hello Balo, are both sentences quotes from Andy Hall, or is the second sentence your words? It's not clear in your post.

I too am encouraged there's some movement on the DNA trail, though it's itsy bitsy baby steps - and things which should have been done 10 months ago. The prosecution + RTP + Headman's people are still dragging their feet for all it's worth - trying to stifle DNA verification is every way they can. They're delaying, obfuscating, contradicting each other (an investigating cop testifies that some DNA items have been lost and/or used up. That evening, his boss says, "nothing has been lost." ....though that doesn't account for the missing hair). The judge appears to be singing from the same hymnal as all the other authorities who are paid by taxpayers and whose boss is the self-instated PM.

Note: The most crucial aspect of the DNA trail is: is it being compared to the actual DNA taken from Hannah? A police spokesman can stand in from of a microphone and say 'yes' with a grin - but that's not good enough for the discerning majority among us. Getting DNA from the scapegoats or from the former prime suspects is not so difficult (though maybe it is with Nomsod, who refused to comply for many days last year). However, the DNA found in/on Hannah has (supposedly) been kept in the care of RTP - the very organization which is orchestrating the cover-up. It's obvious why that data cannot be trusted. If the Brit experts ever play their hand, and it's shown that the their data differs from the RTP data, I think the judges will say, "well, they don't agree, so we're going to disregard DNA evidence." Instead (sorry for putting an opinion on top of a hypothetical) the Brits' findings should supersede the RTP findings because (A.) the Brits don't have an agenda, and (B.) The Brits have superior lab equipment and technical prowess, and have more expertise with DNA than Thais experts.

agree with most of your post - but you couldn't hold back bringing the PM in, could you

don't forget the divine savior of thailand had intertervened in the case saying the famous "perfect job"... and specially influenced (trying at least) the trial result. (as always in such "big" case, we know the words of PM is more worthy than solid evidences)

but hey, i would want to hear Pm right now about his perfect rtp 's work

Thai solicitor says Burmese man admitted murdering Hannah Witheridge and David Miller

A Thai solicitor has said that he was present when a Burmese man admitted raping and killing Norfolk student Hannah Witheridge and Jersey back packer David Miller.

Pittaya Yaipetch, explained in court, during the ongoing trial in Koh Samui, that one of the 22 year-old suspects from Myanmar had freely admitted following Ms Witheridge and Mr Miller in the early hours of September 15 2014, and raping and killing them.

“The suspect told the investigating police officer that he was with the co-accused on the beach at about 3am when the victims walked past them. He said they went to a place further along the beach and started kissing,” said Mr Yaipetch.

“Zaw Lin said he hit Mr Miller with a garden hoe while he was lying on top of Ms Witheridge but his victim jumped to his feet and tried to fight him off. That was when he hit him again and he fell down.

“The suspect said his friend, Wei Phyo, was punching Ms Witheridge until she fell unconscious and then he proceeded to rape her. Zaw Lin told the police that he hit Ms Witheridge in the face with the garden hoe when she began to regain consciousness, before raping her himself.

The solicitor said Zaw Lin admitted hitting her a second time with the hoe “so she could not survive and identify us.”

But no blood on hoe from David Miller?

From the above article

'The family of Ms Witheridge and Mr Miller were not in court to hear the detailed description of their deaths'.

Shameful reporting from the local paper, which should say 'were not in court to hear the detailed description of the alleged confession which was later retracted'.

This all goes out of the window if traces of a shot is found in the autopsy though.

As reported by the Times Newspaper who claim they have information to suggest this is the case. As well as Andy Hall describing some Fantastic revelations from the Forensic's will be disclosed.

I suggest they are allowing the prosecution to dig themselves a hole so deep that they cant see the daylight.

Then The defence will fill it in on their heads. LOL...

Accused migrants undergo new DNA tests

DNA swabs of two Myanmar defendants were retaken at the Koh Samui court yesterday, as the defence continues to contest the physical evidence against the pair, who stand accused of murder.

The two Myanmar migrant workers, Ko Wai Phyo and Ko Zaw Lin, are charged with murdering David Miller, 24, and murdering and raping Hannah Witheridge, 23, on the Thai tourist island Koh Tao. Both defendants have recanted confessions, which they claim were given under duress.

The defence maintains that the Rakhine natives are being scapegoated following a botched investigation that was rushed to clear Thailand’s marred image as a tourist paradise.

Significant' new evidence supplied by UK as British backpackers murder trial begins The families of Hannah Witheridge and David Miller, who were killed on the island of Koh Tao last September, arrive in court for trial of two Burmese suspects

12:24PM BST 08 Jul 2015

The families of two British backpackers murdered in Thailand last year arrived for the start of the trial of the alleged killers just as the defence revealed that new evidence supplied by the British authorities could prove their innocence.

Hannah Witheridge, 23, from Great Yarmouth, Norfolk, and David Miller, 24, from Jersey, were killed on the island of Koh Tao last September.

Their battered bodies were discovered on Sairee Beach on the morning of September 15. Two Burmese migrant workers, Zaw Lin and Wai Phyo, are standing trial for their murders on the nearby island of Koh Samui.

Just before the families arrived at the Koh Samui Provincial Court, lead defence lawyer Nakhon Chompuchat said: “We have received information from the British authorities that shows inconsistencies in the prosecution case. It is significant evidence.”

If the B2 are found not guilty then this case would show the RTP to be corrupt to the core.

Would anything be done about that going forward ?

Large scale reforms and improvements?

If any other business or organisation was found to be so ineffectual it would be disbanded and rebuilt.

I predict a landslide victory for the defence, today. Why? Because they're better prepared and more professional than any prosecution witness.

I'm getting SE's posts loud and clear today - no more blank spaces. Thanks 'Stealth'. smile.png

Isn't it insane how little coverage the trial is receiving? I know it's still the prosecution court at present I just wonder if people already made their conclusions and moved on until the trial is over. Hopefully not because people are utterly clueless coming to Thailand and things aren't getting rosier. Another day tomorrow, let see what this obviously dark "translator" has to say.

Nor any of David's blood on her despite him being struck while on top of her. Also no explanation for the stabbing type wounds. Even the roti-seller knew/knows the story makes no sense so added the bits about a wine bottle being used. Oh and there's no way Ms Witheridge was only hit twice.

This whole scenario is only likely if you believe that the victims were engaged in a romantic liaison on the beach when they were attacked. I don't, I'm afraid. I won't go into the reasons why I don't believe it as it as been discussed ad nauseam on this forum already.

A definite hush up has taken place with this case. Poss orders from high up. Pressure on websites and newspapers Also most Thai people are impotent in cases like this. As is the rest of the world and also the Familys in this case.

It appears Hannah's family aren't in Thailand? despite donations in the region of £15,000 for them to attend as well as a charity who was donating money/tickets etc to help them. Just highlights their helplessness they must be feeling. IMHO

We are being asked to believe Hannah met a Thai person in the Bar. Had a bust up row etc and then skittled of down the beach for a quick one with David??

Don't think so somehow. More like pursued down the beach as they headed home to their rooms which where adjacent in the same block. David having helped her leave the Bar and the problem.

The pack followed and we see the results. A death of the person who helped her and an awful rape of the young women they couldn't have by consent so they took they anyway. Feeling they have the power to destroy lives at their whim and the support of their local Plod to avoid conviction.

Ahhh, the PM card. The Thai PM was quite opinionated in the initial weeks after the crime. He wasn't shy about voicing his opinions. He's now a player in this drama, like it or not. One of his early statements was something about 'pretty farang women who wear bikinis, should not be surprised if bad things happen.' Of course, Hannah was not wearing a bikini.

Some other of his utterances:

"There are no scapegoats."

"Thai police follow the same instruction book as the British police."

"Don't use the word 'Burmese' when describing the defendants."

"There is no cover-up."

"Police are doing a perfect job."

Does the PM have an agenda? Naaaaww, perish the thought.

A lawyer testifying today. This is the first I've heard that a lawyer was at the 'safe house' during the interrogation. Who does he work for? Does he speak Burmese? Is the lawyer done with his testimony, because I haven't heard mention of the broken bottle (earlier proposed by Thai authorities to have caused David's stab wounds). Perhaps we'll hear about that when the roti vendor testifies tomorrow. I'd like to hear what the RTP's latest spin is - on the broken bottle. If the prosecution brings it up, then it will be added proof that the B2 were tortured. Reason: no bottle or glass were found at the crime scene, and mention of a broken bottle was first broached by the roti vendor/translator himself. In other words, a non-professional angry/scary man (the B2 said they were more scared by the roti seller than anyone else) appears to have introduced evidence (during the interrogation) which has no bearing in fact. If the B2 were so scared that they agreed to add the broken bottle as one of their weapons, ....then it's further proof they were tortured. Heck, the B2 would have agreed that a two-headed sea hawk inflicted the injuries to David and Hannah, if it lessened the torture (psychic and physical) they were experiencing at that time.

I'm assuming the broken bottle theory won't get mentioned by prosecution, for reasons mentioned above. However, it was mentioned in October by RTP. If it's mentioned, it will possibly get the prosecution in a deeper mud hole than it's already in.

Backpacker Murder Suspect 'Freely Confessed'

Zaw Lin claims he was under duress when he admitted killing a British couple - but a lawyer who witnessed the interview disagrees.

By Sarah Yuen in Koh Samui

One of the Burmese men accused of raping and killing British backpackers Hannah Witheridge and David Miller freely admitted his guilt to police officers, according to a Thai solicitor who was asked to observe the interrogation.

Lawyer Pittaya Yaipetch told the court that migrant worker Zaw Lin admitted following and attacking the British couple on a beach on the Thai island of Koh Tao in the early hours of 15 September last year, along with his co-accused, Wei Phyo.

"The suspect told the investigating police officer that he was with the co-accused on the beach at about 3am when the victims walked past them.

Yes... Irregularities in the paper work so they took DNA again! What's the deal with the mother not getting help from human rights? I didn't get that part. Hopefully there's more coverage even with the tragedy in Bangkok unfolding.

Let's get to the bottom of this and get the killers ruined.

Would this be the same human rights people who have let the police miss 4 appointments to answer questions of abuse ?

Would this be the same human rights people who said the Burmese told them they committed the crime ?

I think we can safely say these scum bags are on the same side as the RTP.

The "scumbag" was Andy Hall:

"The forlorn mother of Zaw Lin arrived alone at the court house to support her son supported by two friends, one of whom led her up the steps to the court when Human Rights Activist Andy Hall declined to help or even acknowledge her, an incident caught on a local TV camera."

Crikey.

I've heard differing views of Andy Hall. Whats the score there?

and the rest of the people of the free World that have spend more than 3 years in school ... that will exclude RTP of course and the shills ...

As I wrote a few pages back the first time someone replied to that post --

I was in no way questioning the validity of Mr. Shears' opinion, just that reporting is reporting and opinion is editorial and most journalists and newspapers would be far more explicit in pointing out which is which.

Andy Hall : The swabs from the 2 accused to ascertain with certainty their DNA profiles were taken in front of multiple witnesses in the Koh Samui court

I am happy about this, now we have at least true witnesses so nobody can think it will be faked again . Let's see if they match.

Let's see indeed! May whoever did this to David and Hannah be brought to justice. No more of the shenanigans.

Who is this Thai solicitor/lawyer? The RTP originaly admitted and stated there was no lawyer present in the early interviews. No doubt this is a local K.T. legal eagle who deals with the local RTP regularly much the same as the local quack who only turns up when it suits him $

No matter how safe you feel. Never take it for granted that a place is safe.

Drink in moderation and be aware of danger. This was straightforward murder, but targets are usually not picked randomly.

excuse me ????? i don't understand very well... one blaming the victims ???? must be a divine savior of thailand's worshiper

2 men could be in jail for life and may be put to death and this is all you post about?

Wow, a real big 'incident'. How this is an incident is beyond me.

The incident is played up in the hope that it will inhibit donations to the defense funds, especially the one administered by Andy Hall.

And we already know theres 3 or 4 posters who take every opportunity available to them to discredit the defense or Andy Hall.

What amazes me is that they are allowed to continue to call people like Andy Hall (who is a decent person) "A ScumBag" without any instance of moderation. In fact if I was Andy Hall I would be sticking one right into these posters.

It was Silvarado a brutal murder, however brutal murders happen every day all around the world. So the case will not get the exposure that it got at the start.

They were in the wrong place at the wrong time, it matters not if the Burmese two, get found guilty, it wont change the past.

Many people let their guard down on holiday. For what its worth after reading the background the Burmese two are probably guilty, but will now walk.

No one thinks they can change the past.

We want to affect the future.

We want that the correct people rot in jail.

We want to be sure that innocents are not destroyed and the guilty free to rape and murder again ....in the future.

I'd love to know what background you are alluding to that is so convincing that you feel the b2 are probably guilty.

convince me...please.
