Foreigners cannot rent womb in India

INDIA: -- Foreigners cannot rent a womb in India, the government on Wednesday submitted in the Supreme Court.Surrogacy services would only be available for Indian couples, it said in an affidavit filed before the apex court.

“The government does not support commercial surrogacy...No foreigner can avail surrogacy services in India,” the affidavit said adding that surrogacy would be available “only for Indian couples”.

The government submitted that it has decided to prohibit the import of human embryo for the purpose of commercial surrogacy for foreigners.

Recently, the Directorate General of Foreign Trade (DGFT) has decided to withdraw its 2013 notification allowing free import of human embryo to India for artificial reproduction.

Import of embryos for research would, however, not be banned, the Centre clarified.

“It is respectfully submitted that adequate provisions will be made in the enactment to prohibit and penalise commercial surrogacy services,” the affidavit said.

Meanwhile, the court expressed dismay over a news report, containing details of Centre's probable reply to be filed before it, which said that it would not allow couples from foreign countries to have children through surrogate mothers here.

That article was vague. Sounds like this isn't a done deal yet but MIGHT be in future. In any case, India has been a major destination for foreigners seeking surrogacy services. Same sex couples are usually not welcome. They have been more welcome in Nepal.

The Indian Government is correct in wishing to prevent (usually) poor women from being exploited.

Those who wish to employ a surrogate should do so in their own countries.

You're painting this as a black and white issue, when actually it's a grey area issue.

First of all, surrogacy is illegal in most countries.

As far as exploiting poor women, that definitely happens a lot of the time, but on the other hand in many cases the large cash infusion received is sometimes a life changing event for both the woman and her family.

There are some operators in India who have been very ethical about this. Making sure the women are educated on how to deal with the only big chunk of money in their lives from a FEMINIST perspective. In other words, the woman aren't so much exploited by the foreigners, but more frequently from the local MEN in their lives who tend to want to take control of the money often in ways that are not going to improve the family's lives for the long term.

That all said, India is a sovereign nation and if they are going down the path of banning surrogacy for foreigners, they have every right to make this choice.

But don't kid yourself, this will be bad news for many Indian woman who will not have this chance any longer.

But NOT this one.

A few hundred dollars will, long term, make little or no difference to the lives of these EXPLOITED women.

You're joking, right?

It's not a few hundred dollars.

It's generally well over 10,000 dollars and these woman are generally poor rural woman where the money, if properly invested, can indeed change the lives of their families for the long term.

Of course it doesn't always work out that way. But it's a chance they didn't have before.

I don't care if you respect my posts at all. I think if properly managed by ethical operators, and some of them are ethical, surrogacy in India can be a win win for the clients and surrogates. But it's totally up to India to choose about legality, or not.

If kept legal, the smart thing to do would be proper OVERSIGHT of the operators to weed out the bad players.
