Pheu Thai party rejects NCPO’s Order No 39/2558

BANGKOK: -- Pheu Thai party today issued a strong statement rejecting Prime Minister and NCPO Chief's invocation of Section 44 of the interim constitution to protect government officials in the management of the rice stocks from the rice pledging scheme.

It says such execution of power by the prime minister is against the rule of law and to discriminate against those who
are currently facing trials under the justice system.

In the statement released, the party calls on the prime minister to revoke his Order No 39/2558 reasoning that the order is irrational and unfair.

It cited an earlier order No 63/2557 by the prime minister dated June 12 last year that all people will be fairly treated under the law, particularly rights and equality in the justice system.

But it said the invocation of Order No 39/2558 has twisted the prime minister’s own written and verbal statements.

It is tantamount to create a new rift in the Thai societies which he has tried to heal, and instead will be widened further, the statement said.

The party said his order has protected government officials for their management of rice stocks left over by the rice pledging scheme, but deprived the rights of people to defend themselves under the normal justice system.

This was also an obvious and serious interference of the Judicial Power by the Administrative Power, the statement said.

It finally called on the prime minister to revoke what it called a discriminative order in order to uphold the rule of law and to create a reconciliation environment in the country.

Gen Prayut claimed that the invocation of Section 44 to manage rice stocks would help speed up the release of huge rice from the storage which might be rotten if awaiting for the end of the time-consuming court trial, and would also help to minimise further loss to the country

I can see what they are trying to do with this law, but i can also see it potentially could cause a multitude of problems, not least how can anyone be sure those doing the investigating are carrying out their work honestly.

Surely if they can use this law for this, they are in affect saying it is fine to do this, it will not affect anyones ability to a fair trial, so why not just have this law their full time?

Poorly crafted order, but that is expected from any legislation or regulations promulgated by government officials in this country. Partly to do with thee arcane language which is not sufficiently precise for drafting complex legal rules, but also, and primarily, the consequence of having a terrible education system. I can understand the policy behind the order, PTP would bog government officials trying to clean up the program and its corruption with defamation lawsuits. That's the way of PT: nonsense defamation suits, nonsense retaliatory lawsuits and nonsense appeals.

it is an interesting point you make and one I have also thought about, my conclusion is that it exposes the inadequacies within the Thai justice system which are many.

If the concern is the defamation law - then a simpler and less controversial solution would be to (1) make defamation a civil only matter (ie financial penalties only, no jail time) and (2) allow the defence of "the truth" within the defamation law.

This would mean that no honest government official, now or in the future, would have to fear an accused defendants defamation charges.

Those assclowns won 3 successive democratic elections. If they are called assclowns and winning, what you call those who lost and those unelected PMs.

Well, now gentlemen(NOT), this is an order (not some proposal), it's the NCPO's way now, so you take it, or you hit... the road (highway) jack(a..es).

Ah, that would be the day, imagine: bye-bye PTP, good riddance UDD, how peacefull it would at once become here!

All existing political parties and organisations, including PTP and UDD of course, should have been disbanded in the first place last year, all elected politicians from District level to the House (and Senate...) banned for life, to start with a clean slate, beginning with a, clear and restrictive, 'code of conduct' for the new parties to come, including concepts as: a binding program, ethics, transparency, ...and responsibility!

A bit too late for that though, I'm afraid, Generals, though you knew that well enough, so you must have had a 'very good' reason, or rather a quite bad one IMO, not to take such a purely common sense measure, ...to make a truly 'democratic' future possible for Thailand at last! But probably you might make yours the words spoken by Thaksin himself: 'Democracy is not my goal', alas...

If you just got past your hate for people that disagree with you and thought about the corruption opportunities that this order creates. Civil servants now have an open invitation to steal tax payers money and have a never go to jail card. No politician have been found guilty of fraud or corruption relating to the rice scheme but many civil servants and businessmen have been convicted, which shows who are the real corrupt ones in this country. As to your obsession about Thaksin, the country don't need him neither do they need small men in green.

You are so naive. You think getting rid of PTP and UDD will be the panacea for peace than you really don't understand Thailand and the military. I suggest that you spend some time to research the reasons for past coups staring 1932. Common themes stood out like a sore thumb. It is the same excuse for this coup like purging the country of political enemies and rivals, increasing corruption and inefficient leaders. The same reasons will be used for the next coup.

According to this report from the broadcaster we can trust, the Pheu Thai party is concerned that the invocation of Order No 39/2558 has twisted statements by the PM. They also suggest that execution of power by him is against the rule of law and discriminates against those who are currently facing trials under the justice system.

In a different interpretation, Prayut was quoted elsewhere as saying (during one of his weekly Returning Happiness to Thai People broadcasts in September), “The power (of Section 44) is used in the most constructive and transparent manner, given that there are committees overseeing the use of this power while the operations proceed strictly according to set regulations".

So, who’s right? Just like two dogs fighting over a bone.

This should be seen as a significant setback in reconciliation efforts, and is likely to cause the junta to turn the screw even further in its efforts to hobble Pheu Thai. The result will be renewed tension at the start of one of the most significant court cases in Thailand’s recent history - thus ensuring that this country’s citizens will remain divided in their allegiances for a very long time to come.

Definitely no winners, only losers!

When all else fails hit them with the ol' "anti-democracy" tag, that'll teach em'. You remind me of a former colleague of yours who used that anal term several times in every post he made, also to no avail.

Funny how someone who supports a pack of thieves, criminals and liars who were anything but democratic has the audacity to even use that term.

One thing is certain: the current govt will not touch its paymasters in Sukhumvit and Silom. They will continue to rip off the community as they have for decades, with impunity and immunity

Do you mean the Shin fan boy trio? They do post support for the highly undemocratic one family one rule autocracy party.
