Have a couple questions in regards to my girlfriend and baby,

1.. When my girlfriend applies for her tourist visa as it will be a third visa without problems and she has doucuments to prove she has land and spent 4 years at uni, Telling them about our baby will that make the application as smooth as the first 2 visas she got? I will be stating the purpose of visiting Australia will be to spend 6 months with myself and other family members due to my work commitments and i am also wanting to spend time with our baby together ..

2.. Our baby will be dual citizen as registering our bub as birth by descent at oz embassy, and having all necessary documents to prove , Then my girlfriend has her application approved for 6 month tourist visa, Can we marry in oz and apply for spouse visa while she is already on a visa?

Reason being that if we marry in the first 3 months of her 6 month stay and i am allowed to apply for he spouse visa i am thinking it will cut the waiting time down , If someone may throw a few suggestions to me will be happy to read... Cheers tinytot

You asked the same question in this thread and there are plenty of replies for you to consider.

You and your partner now have a baby together and the Embassy may ask you why you are applying for a third Tourist Visa when a Spouse Visa may be more appropriate.

Thanks Mighty Mouse for your input..

I was going to tell the Embassy we are applying for a 3rd tourist visa as now we have the bub and i am working to much for taking time off for visiting my girlfriend and baby many times of the year.

Reasons for bringing my girlfriend and baby are significant to me as being able to support my girlfriend and see my baby grow up for 6 months or 12 months on tourist visa,

Also was going to tell them that we are going to marry in late 2007 so if i apply for spouse visa i would not get to see the most important 1st year of my baby growing, as will have to wait for ?? months until approved..

Mighty Mouse do you think that sort of letter would be suffice?

We have had not had a problem before with visa and the officer in charge of my girlfriends case even went on to tell her that she has no problem coming to Australia with me, That was our last application we had..

Thanks ... tinytot

It's not up to me to tell you how to run your life but if I was in your position I'd be making the relationship as permanent as I possibly could and as quickly as I possibly could.

What will you do if you apply for a tourist visa and they only give you three months, or worst still, tell you that they are not prepared to issue another tourist visa?

If you don't wish to marry until late 2007, it sounds like a Spouse Visa is not on your mind at all. Perhaps you should consider a De-facto visa.

You say that watching your child grow up in its early years is most important to you. I suggest that it is most important for the child to bond with its father as well.

I think you really need to do a lot of thinking and some serious decision making, not just for yourself, but for the three of you.

If you want your girlfriend and baby to be with you in Oz, you should consider marrying in Thailand and applying for a Spouse Visa. With this option you will be separated from both your g/f and child for up to four months whilst the visa application is considered.

If your work keeps you away from Thailand and you wish to marry in Oz you could choose to apply for a Prospective Marriage Visa but the wait could be the same length of time before the visa is approved.

You may be able to apply to the Embassy for priority in processing your application because of your circumstances. I don't know of anybody who has successfully done this before but unless you ask you will never know.
