Hi my Thai GF was refused a holiday Visa today on 2 counts.

1. Relationship History, not a problem have phone bills emails ect.

2. Evidence needed that she will return home after the holiday.

Problem here is that she live and works at home on the farm with her family. (150kn NE Udon Thani).

She has one daughter and I have supplied translated birth cert for her but they want more.

What can i give them to show she will return home?

Here are the actual reasons from www.justice.ie

RH Relationship History – Have not shown evidence of a relationship being in

existence prior to visa application/marriage.

Note: For Immigration purposes it is not sufficient for a relationship to

have developed over the internet or by telephone/sms. A relationship must

include a number of face to face meetings (excluding webcam) between the

parties. You must satisfy the visa officer that the relationship is bona-fide

OB Obligation to return to home country not shown e.g

· No social, economic or professional ties in home country

shown or

· Obligations shown have not been deemed sufficient

I'm no expert on Irish immigration law, but from what you've posted, it would appear that one of the principal reasons your girlfriend was refused was that you've never met. Before you consider applying again, I'd get that rectified, and arrange a couple of trips out to Thailand.

With regard to your girlfriend's incentive to return, they'll be looking for her to have a valid reason why she has to return to Thailand at the end of her holiday. What constitutes an incentive to return is not cast in stone, but, for example, having formal employment to go back to, land, savings, or sick relatives can, in the right circumstances, meet the requirement.

Thanks for the advise Scouse.

I have been to Thailand to visit her twice this year, 2 weeks in june and 4 weeks in July/Aug.

I stayed with her family in the NE.

I did provide details of this and copys of the visa stamps. Also she has one child, i had her birth cert translated and included it in the application.

Regarding the sick relatives and land ect, that will bolster up the appeal. They did ask me does she have a social security number? Is there a thai equivalent? She has an ID card and a Passport. I think she has some card she uses when she brings the children or family to the hospital.

All help and suggestions very much appreciated as i wish to appeal this asap.

Without knowing more about your girlfriend's exact circumstances etc. it's hard to say exactly what will constitute an incentive for her to return.

However, on the assumption that you were born in Huyton, you will probably also be entitled to a British passport which will come in handy should you ever get married.

It says something when all the Irish are leaving Liverpool.....

Well I do have a British passport and was born in Lpool. I have been living in Ireland for nearly 20 years now. I applied to the Irish consulate in BKK and the application was refered to Dublin. I could get a Irish passport I guess if thats any addition as both my parents were born in Ireland even though they live in West Derby. They never mentioned any thing about my passport being British.

I've got a pal who lives in Norris Green (he reckons it's West Derby because he wants to be posh), so we're off to the Jolly Miller tomorrow for a pint or several.

I'm not suggesting that you should marry your girlfriend solely for immigration purposes, but, as things stand, you're a British citizen exercising his European treaty rights in another EEA country. As such, you are entitled to have any immediate dependants, irrespective of their nationality, join you, free of charge. Once married, your girlfriend would be classed as a dependant.

I went through all the hoops to get a visa for my BF 2 years ago.

Biggest obstacle as always is the OB (obligation to return home) clause

Its so subjective and is the "get-out-of-jail-free" card as far as the Dept of Justice is concerned...

For the relationship history:

Did you submit photos of you together

When did you guys meet?

When did you tell them you met?

June to October is not a very long relationship history... this may be a reason for refusal as you don't know each other long enough

OB:

-Letter from employer - without this no hope - know anybody who can employ her in a respectable job?

-Pics of Mother and child

-Pics of elderly parents

-Pics of her monks etc - religious reasons to go home

-Does she own any land or property? If not buy some - Land in Issan is quite cheap. And submit the shanoot (title deeds to the house)

-Get her to sign a declaration:

I hereby declare that if I as named above enter Ireland for the purpose of a holiday, I shall guarantee the following items:

I won't engage in activities other than those permitted for the purpose of entry into Ireland and will abide by Irish laws and regulations.

I won't be a burden on the state and I or my guarantor will cover my living expenses, return travel expenses and medical insurance whilst in Ireland.

I will return to my home country, Thailand and will leave the state on or before the expiration of my permission to remain.

You should do something similar, have them both witnessed and signed

-Write to your local FF TD (MP equivalent) tell him your story and ask them to write to Minister McDowell on your behalf

Is her passport new?

If so get some travelling around SE asia done, so you can state that she understands visas etc and has travelled extensively in the past

This advice may all be too late for the appeal... but persevere and you'll eventually get it...
