Keep the immigration overstay re-entry ban, says Phuket poll

PHUKET: -- The stern Thailand immigration re-entry bans for foreigners who illegally overstay in the country has received strong support from Phuket’s expat community.

The new regulations stipulating the bans came into force late February. Under the new rules, bans for foreigners who “surrender themselves” to immigration for overstays range from one year for overstays of 90 days or more to 10 years for overstays of five years or more.

The penalties for those “caught” overstaying in the country are even harsher.

Yet two-thirds of all people who cast votes in the poll, which asked “How harsh should the immigration overstay re-entry ban be?” voiced their support for the bans.

A total of 36 per cent of respondents to the poll voted, “The ban is understandable against adults, but should not apply to children under 18 years of age.”

At the time the poll was launched (Mar 18), Immigration had yet to confirm whether or not children would be banned under the new rules.

But by the following Friday (Mar 25), Immigration Bureau Chief Lt Gen Nathathorn Prousoontorn visited Phuket to confirm in person that children would be exempt for the re-entry bans.

Absolutely right; overstayers out, obey the law like most of us do.

I agree, but this new law has also locked a lot of the undesirables into Thailand.

How so ... ??

obvious they have gone underground and keeping a very low profile, they will stay here until they die or are caught (or get a fake PP/visa)

Considering the new rules specifically exclude children he is out of line and going against the directives of the head of immigration, his superior.

Go on that's just a wind up! In many countries these days there is something called a 'Migrant Crisis' whereby many thousands of people are trying to move from their home country to somewhere more accommodating.

The local populations of the receiving countries are beginning to say 'stop'.

In Thailand there has been a blithe refusal by visiting foreigners to recognize the sovereign rights of its people, no matter how haphazardly, the rules are enforced.

The people who overstay their visa, do so knowingly - unfortunately by doing so they create more difficulties for the foreigners who are in Thailand legally; the same is true for the European migrant crisis.

If you are here in Thailand legally you have nothing to fear if not, as in any country, you know the consequences.

Don't bring your childish socialist claims of the rich versus the poor into the argument - your so called Colonel Blimps have earned their right to stay legally, your friends clearly have not.

The Thai police is either stupid or ignorant of not knowing what happened to the immigration offenders in this region and yet they could still come out with mickey mouse rules. Speechless!

Anyone over two weeks that does not have a genuine medical reason should have the book thrown at them.

Police should also be active in passport checks as we need to be honest in that thailand has a huge overstay problem.

Although there are some nice people on overstay many of them were a pest to the expat community. Most overstay due to financial reasons or falling madly in love with a bar girl which leads to financial problems. They hang round bars and pester customers more than ugly aged bargirls. To my left some undesirable girls is asking me for a lady drink and to the left is an expat asking me for a couple hundred baht.

I have had dozens of them ask me for money at bars. Some have turned up to my house hardly knowing me needing money for hospital bills etc... In the beginning I fell for the lending of money thinking it is a guy down on his luck who needs some cash until next week. Most I never got back And the rest I literally had to fight for. Just not worth it.

Thailand does however need a visa for younger wealthy people. There is plenty of guys around 40 with enough money to live in Thailand for years but like me I struggle with visas.

I feel very sorry for some of you guys.. turning on anyone who "overstays," who cares, just who do they hurt to be so venomously berated by you guys. You really should find something to do, your home countries are so lucky not to have you around. Yes, I know they are breaking the "law" I suggest in some way we all do, almost every day. If you speed you are probably more dangerous than an overstayer... GROW UP.

Your spiteful venous replies will only make me laugh, and prove just how right I am.

You can get an Elite visa for 500k Baht/5 years.

500k is not realistic. It it 20k upfront...

Most young business people can not commit to one location for five years.

4K year to year would be a better option.

My sentiment exactly my friend.

For many a year these unsociable amulet wearing thainess degenerate groupies, have hated

overstayers, with a vengeance. Subsequently to such a degree, voiced their disgusting self-opinionated venomous outcry in many a tv forum.

They've relayed hateful spite for anyone having dared to overstay visas irrespective of their circumstances. These turncoats who blab all day about us irresponsible Ferangs as if they really think they've somehow become a paid up plastic Thai married to some honest woman in Thailand now become part of her 300 family members. The group family pictures are somewhat laughable and stand out like a sore thumb being the odd man out.

These clowns are not funny.

Poll isn't that surprising as most expats are old curmedgeons. No need for expensive border runs since they're retirement age, or married a bargirl.

And now they desperately want to feel like a big fish in a small pond so any measure that reduces the number of other white faces here is met with cheers.

My post was more directed at those foreigners that could not afford a proper visa, or meet the requirements, or do a visa run, let alone pay their overstay fine.

These people, even if they were to have the financial capacity in the future, will now stay underground, because to hand themselves in under the new law, will see them banned from Thailand, so, they will continue on as they have been, possibly even going further underground.

Deported back to their home country, legally change their name, apply for a new passport, and back into Thailand.

Malaysian and Cambodian immigration take fingerprints - it's about time Thailand did as well.

The use of my term "undesirables" was from a viewpoint of Thai Immigration, not myself.

Of course the new overstay rules should stay - though possibly need some small adjustments. In 6 years we have seen annual changes to the visa rules (for those over 50) change from a self declaration of sufficient funds too a requirement for 65,000 baht a month on the 'O' visa, the scrapping of the triple entry tourist visa and now the overstay revision. All due to the plague of farang beggars who have inadequate funds to stay here or were working illegally, It has made visas for those of us with modest but adequate means a pain. People complain about illegals in the UK - probably just as high a % over here - just being an expat doesn't stop them being what they are - illegal immigrants.

Sooner or later, one way or another, they'll eventually float to the surface. The re-entry ban doesn't so much get them OUT as it does keep them from coming BACK. Except, I'm not sure it's happening and the bans are actually being imposed. Has anyone heard of someone who's had the ban applied to them on the way out?
