Chuwong’s 300-million baht share embezzlement case dropped

BANGKOK: -- The Department of Southern Bangkok Civil litigation has dropped charges against former deputy commerce minister Pol Lt Col Bunyin Tangphakorn and three other accomplices in a case that they were accused in a conspiracy to steal the shares of the slain construction tycoon Chuwong Sae Tang worth over 300 million baht last year.

 

Spokesman of the Office of the Attorney-General Somnuek Siengkong said the charges of forging official documents and the use of forged documents, theft and receiving stolen property, were filed by the Crime Suppression Division  against Bunyin, Ms Kanthana Sivathanapol, a caddy and pretty, Ms Uracha Vajirakulthon, and her mother Srithara Promma in alleged involvement in the missing of listed stocks worth over 300 million baht from Chuwong’s portfolios.

 

However all the changes were dropped by the Department of Southern Bangkok Civil litigation.

 

He said the full investigation case file was under scrutiny by the deputy attorney-general.

 

If the deputy attorney-general agreed with the drop charge, then it would be forwarded to the Royal Thai Police, he said.

 

If the Royal Thai Police commissioner disagrees, the case will be returned to the Office of the Attorney General.

 

If the deputy attorney-general agrees to the charges, then all of them will be brought for prosecution immediately, he said.

 

He assured that justices would be provided for all relevant  parties.

I see, all very clear, what on earth is going on with this, sounds to me like one of the accused has some dirt on a very high ranking person and they are threatening to expose unless the case is dropped, that is the only reasonable explanation I can think of for this rather sudden U turn, the last time I read about this case it was looking pretty obvious what went on, I wonder what sort of deal has been done - we will give all the money back provided we don't go to jail maybe......who knows

once again we see the thai justice system failing miserably, they had forged documents but are not following through with the charges, looks like someone has found a cake box in their office, what other explanation can they come up with when they actually had evidence against them. This is definitely highly suspect, hope the police or the DSI actually check out those involved in this and then push for the charges to be reinstated and certain others tossed into jail

Not when investigative journalism is limited to checking whether any press releases have ended up in your spam folder.

There was one investigative journalist in Thailand ,but he left a while ago.due to death threats to him and his kids.

I think that you may well be right to surmise that one of them has the dirt on someone with enough "influence" to ensure that the case is dropped.

 

I doubt very much whether returning the money features in any plans though!

Prosecutors split on whether Banyin and Ms Kanthana should be indicted in court

BANGKOK: -- Senior public prosecutors were split about whether former deputy commerce minister Banyin Tangpakorn and his girlfriend, Ms Kanthana Sivathanapol, should be indicted with charges of forging documents for the transfer of 300 million baht worth of the shares of Chuwong sae Tang, a construction tycoon, to both of them.

 

The split opinions among the prosecutors responsible for the case prompted the suspects’ lawyer, Mr Seksan Senachu, to lodge a petition with the attorney-general, Mr Pongniwat Yutthapanboriparn, to seek clarification about the public prosecutors’ decision on the forgery case.

 

Mr Prayut Petkhun, deputy spokesman of the Office of the Attorney-General, disclosed that the Bangkok South public prosecutor who has been handling the case had decided not to proceed with the charges against the two suspects in the court.

 

The prosecutor’s decision not to proceed with indicting the two suspects had the support of the director-general of the public prosecution but was opposed by the deputy director-general of public prosecution who wanted the two to be charged.

 

To end the stalemate, the attorney-general has assigned one of his deputies to review the case and to come up with a decision, said Lt Somnoek Siangkong, spokesman of the OAG.

 

If the deputy attorney-general decides not to proceed with the case to the court, the matter will have to be sent to the national police chief for consideration. And if the police chief insists on charging the two suspects, the case will be referred to the attorney-general to decide.

 

But if the deputy attorney-general decides that the case must proceed with the court, the case must be sent to the national police chief.

 

Meanwhile on the same day, the widow and elder sister of the deceased construction tycoon lodged a petition with the attorney-general seeking justice over the case in which Banyin was accused of involvement in the murder of Chuwong.

you mean any competent journalist outside of Thailand who has freedom of the press?  most stuff they dare not publish nor even ask about

IMO, this guy will walk now if they drop this charge as mentioned........there's "only" the murder charge remaining, and that shouldn't be too difficult for Banyin to get out of.

300 mil. is a lot more important than a lowly murder wrap!

If this sudden and somewhat strange decision by the prosecutors is allowed to stand, and the case and charges are dismissed, then no fraud crime as been committed and the prosecutors are saying the share transfers were all legal, above board and no forgery. Seems somewhat in contrast to previous evidence commented on by police and the stock exchange.

 

But, charges against people of "influence" and connections have a habit of suddenly being dismissed despite evidence to the contrary. One of the sad things here.

 

And if no fraud crime, then no motive for murder, so must've been an "accident" just like he said all along. Someone pulling strings somewhere.

You can't have an effective government without and effective justice system. And you can't have wither without a free press and now free media. 

Until that changes things will never progress or transform. 

 

(In the West we now suffer from having the media in the control of a few whose vested interests subvert the idea of a free press, but that's our problem).

Actually, Mr Banyin is one of the founding members of Mr Thaksin's inaugural TRT party and apparently believes 'We should all have to play by the same rules':
 

Meanwhile, Banyin Tangpakorn, Thai Rak Thai's Nakhon Sawan MP-elect, said if Thaksin is forced to take a political break in the next election, other parties' leaders should also be banned from running. "We should all have to play by the same rules," he said.

The 'other' paper reports a DNA test shows a baby born to a woman linked to the theft of millions of baht in shares was fathered not by the construction tycoon but by Banyin...
 

The other paper also reported on the death of  Banyin's former wife who was killed in a 'similar' (allegedly staged) car crash 25 years ago....

Amazing that even for wealthy people there is no justice.

 

Banyin's wife died under eerily similar circumstances in 1991.

 

Chuwong dies in a relatively minor accident, from multiple blows to the head (5 iron, after their round of golf?).

 

Banyin, and the three women loot Chuwong's account(s).

 

One assumes that these four had to "share the wealth" to avoid prosecution.

 

Chuwong's family have petitioned national police chief Chakthip Chaijinda (yesterday), calling for justice in the share transfer case they believe is related to his alleged murder.
