Hi all, 

 

Just a quick FLR M date check for application if i may.....

 

Spouse Visa valid from 29/01/14 - 29/10/16. This is the first time visa in the UK. 

 

Arrival date in UK 27-03-14

 

Therefore i have it as 27/03/14 + 30 months = 27/09/16. 

 

I have most of the documents ready to go, just wondering if there is a deadline, other than the 29th October? I know its 28 days before 30 months in the UK, which is now effectively...but i wasn't sure if i had to have the documents in 28 days before expiry date or something. 

 

Also just want to make sure i'm in line with the 28 day rule on financial documents. 

 

Was concerned there may be a gap for ILR, had i applied too early, so if someone can just give me a quick bit of advice that would be greatly appreciated!

The qualifying period for ILR is 5 years, 60 months.

 

This is usually made up of two periods; 30 months with the initial visa, 30 months with FLR.

 

The latest she can apply for FLR is the day her current visa expires; but she can apply before that. However, if she applies too early her FLR will expire before she is time qualified for ILR so she will need to apply for a second FLR.

 

So she should apply after she has been in the UK for 30 months; but she can submit the application up to 28 days before that date and her FLR will commence on that date.

 

The supporting documents need to meet the validity requirements, e.g. no more than 28 days old,  on the day she submits the application, not the day her FLR will commence.

 

Remember that the language requirement for FLR increases from A1 to A2 from October, so unless she has A2 or better already she should get her application in before then if she can.

Thanks so much for the usual awesome advice. 

 

So in our case i think best to wait till 27th September to apply. I get paid on the 18th, so will be within the 28 days document rule. 

 

In terms of the English test, we have A1 secured from before, and were not sure of the cut off...so took B1 trinity last week and aced it. Thought that might be best for the ILR application anyway providing it is still valid. 

 

One other question actually whilst i have your attention...i was just reading the form, and it appears that i can apply for my wife 2 dependent children on the same form? 

 

My wife 2 children joined us from Thailand this year to live on her spouse, and also expires same time. I thought it was 3 different applications, but appears like only one form in this case for FLR? 3 different charges for NHS & fees obviously.

I'd use her B1 pass; that way if trinity are removed from the approved list for some reason before she applies for ILR she will still be able to use it for that as she has used it before.

 

When children move to the UK to join a parent who has limited leave then their visa will expire at the same time as their parent's so that they can apply for FLR or ILR, whichever is appropriate, at the same time.

 

So yes, they can apply on the same form; provided they were under 18 when your wife made her first spouse visa application.; see 7. Family members. The fee for an adult applicant and two dependants is £2433; see page 3 of form FLR(M).

 

You will also need to pay the NHS surcharge for each of them; 2.5 years at £200 p.a. = £500 x 3 = £1500!

Hi, 

 

We budgeted for £4k, so hopefully smooth sailing. 

 

Good shout on the B1, will use it and then see what the update it as we approach ILR time.
