Phuket police set to formally charge Aussie jet-ski driver

PHUKET:-- Thomas Keating, the 22-year-old Australian whose rented jet-ski fatally crashed into that of his girlfriend Emily Collie, 20, will be called to Karon Police Station tomorrow (Feb 9) to be formally charged with reckless driving causing death.

 

“Mr Keating will be required to present himself at Karon Police Station at 10am tomorrow (Feb 9) to be formally charged,” Karon Police Chief Col Sanya Thongsawad told The Phuket News this morning (Feb 8).

 

Mr Keating and Ms Collie were riding jet-skis near Kata Beach at 4:45pm on Sunday when they collided in the water at high speed, leaving Ms Collie with severe injuries to her neck and shoulders. 

 

Mr Keating said strong sunlight reflected off the sea and made it impossible to see the jet-ski of Ms Collie, leading to the crash. 

 

“We expect the case to take about a month to be heard in court,” Col Sanya said.

 

Mr Keating will not be permitted go home in that time, he added.

 

“He will not be allowed to leave Thailand while the case is being heard as is standard procedure, his name will be added to the Immigration list to prevent him from leaving the country while the case is in court,” Col Sanya said.

 

However, Col Sanya added that he expected Mr Keating to be handed down no more than a two-year suspended sentence.

So, he doesn't get to bury the love of his life. He doesn't get to accompany her home. He doesn't get to mourn her passing in his home country. I am quite literally disgusted at this. It was an unfortunate accident.

 

Only one thing is the motivation here and it is not the rule of law.

A most callous way that Thailand shows total disrespect for the loss of one's dearly beloved wife. Does it get any lower than this. One suspects that the motivation for this is that money can be earned by the RTP and other grubs by this action?

The Australian newspapers and world newspapers are all over this incident and reporting what cruel and insensitive people the Thai authorities can be when they want to be. Is this meant to be reflective of the way all Thai people think? I hope not. Great tourism publicity for Madame TAT.

If there was every any doubt this has finally proven what anuses the RTP are.

There are only two reasons for this nonsense

 

1. a paycheque

2. a cover to protect the jet ski scam business and steer blame where it shouldn't be 

 

 

an Absolute disgrace

'No one at fault,' say parents of Thailand jet-ski crash victim Emily Collie

The parents of a Victorian woman who died in a jet-ski crash in Thailand say they place no blame on her boyfriend, who is expected to be charged over her death.

 

Ian and Sally Collie said in a statement they did not believe Thomas Keating was at fault in the jet-ski crash. Emily Jayne Collie, 20, of Kyabram died on Sunday at Kata Beach, in Phuket.

 

The couple say they are "heartbroken beyond words" about their daughter's death and asked to be left to grieve by media. The Department of Foreign Affairs and Trade circulated the statement for the family on Wednesday night.

The police should drop this now, though the damage has already been done.

 

I'd personally like the family to pay the police to drop the case and get Tom out and back home, then tell the Australian press the full story of exactly how they secured his release.

Why shouldn't he be charged if he was in fact driving recklessly? Say for example, this occurred in Australia and he was found to be driving recklessly, which caused the death.  That being the case would be charged there as Im sure it would be the same in many other countries.  With so much open water, very hard to hit another vessel, unless you are in fact driving too close or playing stupid games.

Very interesting that Aussie complain about the lack of law in Thailand but when one of their own acts foolishly and kills another in Thailand an investigation and charge for the person that killed another is unreasonable. Reckless behavior has consequences in law.

Awful misuse of prosecutorial and police powers.  Neither family wants Keating to be charged.  There is no way to prove even negligence on the part of Keating, and, in order to defend himself, he will end up having to claim that Collie was at fault.  Only conclusion is that the powers that be expect some kind of payout from Keating's family.  Hope the Australian media goes to town with this despicable act.

Exactly.  He said the sun glare was a factor, but It seems he chose to continue operating the jetski  at high speed, apparently unable or unwilling to rationalize the potential consequences.

He would be charged  In Australia, as others  have been under similar circumstances, so why the outrage?

Is gross stupidity an offence?

You have a remarkable Insight Into this Incident If you can say that there Is no way negligence can be proved.

 

Please share your knowledge.

 

That neither family wants him prosecuted Is Irrelevant If an offence has been committed.

 

No doubt Ch 9 will 'go to town', and as they often do, on no more than uninformed sensationalism, and cheque book journalism.

I felt the same way - but the woman's parents accept this as an accident and have no desire to see her boyfriend 'charged'.

Fair comment. Issue being the track record of investigations here isn't exactly pristine, now is it?

How about the Jet Ski rental company?

Were they insured?

Did they give adequate instruction on safety and driving?

Were their staff properly trained in First aid and emergencies?

Probably not on all fronts.

Here you have two young people, who generally believe themselves bulletproof at that age, having a wonderful time and getting carried away.

In the same way that a learner car driver doesn't understand the handling and turning cycles of their vehicle, nor will a novice jet Ski rider.

Yet anyone, even kids can rent one and howl off on full throttle. Unlike many countries, you don't need a licence here.

The Jet Ski industry and its profit before safety, is the real villain.
