I am a 70 year old US citizen, and although I have used several nonimm O (marriage-family) visas over the years, I would like to check the feasibility, advantages of having my now grown sons sponsor me. It took years through several coups for the papers to finalize, but they are now my children with dual citizenship, both working in the US. There is precious little information about doing this visa. 

     I do have a good US immigration lawyer in Bangkok, but I'm not sure if this is his area. It seems that if you have all your paperwork, and all your ducks in a row, it shouldn't be harder than any other visa. I just can't find the ducks. Thai imm website is Byzantine; perhaps a Thai consulate in the US? they are often the least knowledgeable or shall I say help. If anyone here knows the skinny, my thanks.

Are you attempting simply to obtain a non-immigrant visa to enter Thailand?

 

Or are you attempting to obtain annual extensions to live in Thailand for an indefinite period?

 

It is not 100% clear what you are attempting to achieve. (Neither are difficult and certainly do not require a US immigration lawyer).

If your children were living here you could get an extension of stay based upon being the parent of a Thai. 

This from clause 2.18 of the police order.

Quote

(5) In the case of parents, the father or mother must maintain an average annual income of no less than Baht 40,000 per month throughout the year or must have deposited funds of no less than Baht 400,000 to cover expenses for one year.
In case the father of mother requests to be under maintenance of children, the age of father or mother must be 50 years of age or over.

If you are still married to their mother you would not qualify for it.

Hmmmm Living in the US, they could still support me here in Thailand, although they do go back and forth.

I guess I'm wondering if it would be cheaper (no 400,000B) to have them sponsor me rather than the wife for extensions of stay. I could always return and get a 1yr as I've been doing for some time. I've never bothered with an extension.

The 400k baht in the bank is not your only option. You could apply for if you can show an income of 40k baht. At today's exchange rate that is only about $1160.

The might allow you to do it even even if still married but it would be complicated.

I have seen no reports of anybody getting one under the maintenance of children since the added that line in 2014.

Some offices have even refused applications if the children were over 20 years old just to get the extension without the maintenance.

They would be taking care of elderly father, not me taking care of them. I took them from kindergarten past high school and think it's time to retire.

Seems there was once a way for kids to take care of parents. My SS and wifes' part time would cover their 40K, but I hoped the kids would be easier. I've had a yellow book for years, not that it would make a difference.

What you are talking about is not your​ children of Thai nationality taking care of you in Thailand, it is about your children, who live outside Thailand, giving you financial support to live in Thailand. The correct one-year extension of stay for this is the retirement extension with minimum 800k Baht in a Thai bank account. This money and any other money for your living expenses does not have to come from you; it can be remitted to your Thai account by anybody.

Hi ubonjoe. Do you know what they are looking for to prove 40k baht per month? Do you have to show that amount being deposited every month over a certain period of time?

For income earned outside the country you get a income letter to prove your income from your embassy. No other proof is needed unless in immigration wants to see backup proof for the letter. The 40k baht income can also be from working here with a work permit and it is proved by showing 2 or 3 months of income by way by tax payment receipts.

You cannot use your wife's income, only your own income is counted towards the 40k requirement.
