Health Service Support Dept: Thai surrogacy law does not support single men, single women or same-sex couples

BANGKOK, 7 June 2017 (NNT) – The Department of Health Service Support disclosed that Thailand's law on surrogacy does not support single men, single women or same-sex couples.

Health Service Support Department Deputy Director General Dr. Thongchai Kiratihatthayakorn said that a large number of single men and women or even same-sex couples who want children have turned to surrogacy services, which goes against the Protection of Children Born Through Reproductive Technology Act 2015. Under the 2015 Act, couples are required ask for approval from the Committee for the Protection of Children Born Through Reproductive Technology.

Eligible couples must be legally married Thai couples, while eligible Thai-foreign couples must be married for at least three years. The Thai surrogacy law does not allow single men, single women or same-sex couples to obtain surrogate children.

Individuals who do not comply with the law are subject to six months to 10 years in jail, or a fine of 10,000 - 200,000 baht. For more information, please call 02-193-7000 Ext. 18418 or 18419.
