Yingluck in UK on entrepreneur visa: Pheu Thai

FUGITIVE FORMER prime minister Yingluck Shinawatra is living in the United Kingdom on an entrepreneur visa, and has not received political asylum, according to media reports citing sources familiar with the matter.

 

Yingluck applied for a Tier 1 (Entrepreneur) visa, which allows the holder to stay in the UK for a maximum of three years and four months, reports quoting unnamed sources in Pheu Thai Party said.

 

According to the website gov.uk, which contains information about UK government services, people from outside the European Economic Area and Switzerland may apply for Tier 1 (Entrepreneur) visas if they have access to 200,000 pounds (Bt8.7 million) in investment funds.

 

The holders can apply to extend the visa for another two years and possibly for settlement once they have been in the UK for five years, according to the website.

 

There has been speculation that the former prime minister might apply for political asylum to stay in the UK after fleeing Thailand to escape imprisonment.

 

Yingluck, a fugitive under Thai law, has been spotted in the UK on many occasions over the past month with photos of her taken in London circulating on social media before and after the New Year holiday.

 

Pheu Thai confirmed yesterday that Yingluck, a key former leader of the party, was in the United Kingdom, although party members claimed they did not have any further details about her location and legal status.

 

Phichai Nariphathaphan, another leading figure of the previously ruling party, said Yingluck was in the UK and the recent photos circulating on social media were genuine.

 

“But I don’t know if she has applied for political asylum or not,” he added.

 

Phumtham Wechayachai, Pheu Thai’s caretaker secretary-general, said yesterday the party had not contacted Yingluck in recent months.

 

“We follow her news from the media. There has been more and more news [about Yingluck]. Things will get clearer soon,” he said.

 

Yingluck fled the country in late August, shortly before the Supreme Court’s Criminal Division for Political Office Holders was scheduled to deliver a verdict in a case against her stemming from her government’s corruption-plagued rice-pledging scheme.

 

In late September, she was sentenced to five years in jail for negligence in regards to the scheme.

I thought that the Thai government had revoked all of her passports.  How did she get a visa without a valid passport?

Do you think she doesn't have another passport ??

Pretty sure after what happened with her big bro, she would have made advance plans and got herself another passport, just in case :)

I think it's called the Elite visa !! Just provide money, same as U,K...

Passports can normally be bought behind trainstations and bus terminals all over Europe ^^

If this is correct one of the requirements for an entrepreneur visa is - "a criminal record certificate from any country you have stayed in for a total of 12 months or more over the last 10 years".

 

Wonder how she got that! :sleep:

Yes, she is a citizen of Montenegro, Cyprus, Cayman Islands and Tonga, not to mention Niue.

If the BIB drove her to the border, I don't think a piece of paper would be a problem...& it was pre-verdict?

She had all kinds of things set up, she and her bro aren't stupid, and they have the money (not sure where that was sourced from :whistling: ) to do what they want. She probably has multiple documents and she had help to escape, leaving those who helped her to serve prison time, whilst she spends money shopping in London. Such is life

I think her passports were revoked well after the barn door was closed.

i bet they didn't revoke them. for the same reason why there will be no extradition request.

having her arrive somewhere without a valid passport would put the incident in the world spotlight and the thai junta would be under scrutiny from world press. 

there's no win for the junta, either she would be let in without valid passport and junta would lose face. or she would be sent back to thailand where pictures of her going to jail could spark a revolution.

 

an extradition request will not be made for the same/similar reason. it would invite a uk court to publicly judge the junta to determine if she has been treated justly. again there is no win for the junta here.

She didn't have a criminal record when she left :) She does now !!!

Well, there you have it.  She's been granted 'soft-asylum' in the West, Interpol isn't going to lift a finger in response to any Thai extradition request, and Thailand should grasp exactly where they stand with Western nations. They are a non-democratic, regime that is being tolerated as long as it serves the interests of the West such at maintaining trade and as a counter-weight to Chinese influence in the region.  The Shins will be kept in reserve in case that scenario changes and the West gets tired of the current regime and decides that regime change is in the cards.  Then the Shins come back as the knights in shining armor, especially among the disenfranchised up-country Thais.

But you do not gain any right to settle after 5 years like in the UK.

Everyone has the right to apply for PR or even Thai Citizenship I believe ? Could be wrong on that though, I usually am wrong :)

In error in several ways.Interpol has no say in the matter of extradition since it is simply a means of exchanging information.The West has no particular interest in Thailand's form of government as long as it doesn't grossly abuse its citizens (ie different from Myanmar) and remains friendly.There will always be human rights rhetoric but in practice it is ignored (see recent Thailand-UK forum).The West is certainly not interested in Thailand regime change.It is absurd to suggest the Shins are being kept in reserve by the West and it doesn't much matter whether the West is tired of the Junta or not.Apart from being untrue it is also nonsensical since Thailand is a minor country of limited strategic importance.The West will remain friendly whatever regime is in  power.The Shins power bases are in the North and North East and don't need any bolstering from abroad.In any case the Shin influence is treated by the West as almost as insidious as that of the Junta, its main plus factor being that it has democratic underpinnings however flawed.

Sure, you can apply  but it has nothing to do with Elite visa .  The UK Entrepreneur type  visa give some rights to the person to apply for settlement  after 5 years total.

Just have loads of money and that is something she has.. its one rule for those with money and an other for us normal folk. You should never pitty YL she is loaded and can get a Visa anywhere.
