Great thread, great perspective. Wish everyone could read it. Important for non-Thais to know Thailand takes the rule of law so seriously. At least in some areas. Really an example to other countries. At least one other country.

I would say in IDC you don't have access to anything. If you end up there and no-one knows you are there you are on your own until you can find a way, say through a visitor to another inmate, to get your friends aware of the fact.

No ATM's in IDC and they dont let you out to use them

He was arrested 3 June approx 3 weeks ago, can not be arrested for 1 day overdue. My friend just paid overdue 10 days, 5000 baht fine. He probably overstayed months or even years. No money for fine or air ticket, throw the book at him, perhaps he will think next time.

yes you can be arrested one day overdue

you're mate paid on exit i suspect or voluntarily at immo and wasn't caught whilst in the country. 2 different things

had he had a passport check in those 10 days for any reason he'd be in the same position as the OPs mate. IDC, deport and ban.

might be worth telling your mate that so he doesn't do it again

I think in most advanced countries (at least USA and UK), people caught working illegally in work place raid are put in detention and sent back home immediately if they can find a passport. Without a passport, they have send him home with warning not to work. Repeated offenders are put in detention

Desperate people running away from crimes, food, and hunger in Central America are trying to make their and their family's life better by illegally entering the USA in contrast to privileged people born in  rich countries  (winning a genetic lottery) are overstaying (and possibly working also) in Thailand for vacationing.

If on ed visa in Oz and overstay or fail to respond to e-mails, calls etc., or don't attend school (every day of absence reported by mid morning direct to Imm. dept.,), or continued very poor grades and no quick improvement and your on an aircraft very very quickly, I'm aware of cases of non-attend classes and no attempt to contact the uni / school  the Imm. officers quickly searched and found the person, helped them pack their bags right away and escorted to the airport.

i gave australia as an example for a human and decent  treatment of overstayers and illegal workers.

since thailand is a copy of australian pilicies, hopefully they can copy that too.

Update.

 

Getting our mate out was a collective effort and the majority wanted to go down the  British embassy route. A collection was made on one of the smaller Pattaya fora for enough money to pay his fine and buy a ticket. Things are progressing slowly but surely.

To everyone who criticized the Brit who overstayed and didn't follow the "rules", realize that his very forum "Thai Visa" would not exist if the rules were clear and were fairly administered (meaning, no corruption).

There are rules and they are fairly administered. An entry stamp when entering through a border in Thailand clearly indicates the date when one is to leave or before the departure stamp date to make other arrangements to extend ones stay.

 

There is absolutely no reason to resort to corruption to support a stay in Thailand and AFAIK there is probably no other country in the world where it would be legal for one to overstay an entry visa without consequences.

 

As with tax, the onus is on the individual to be aware of his personal responsibility for ensuring the rules are followed.

Exact, post 48 and 49.
I would even add that,
if that person did not buy a return ticket,
it meant that she intended to stay for an unlimited stay.
Round trip ticket costs less than a single ticket.
So let's stop whining about the irresponsible ones.

I think you might find that many people don't buy a return ticket. They might have plans to travel to another country other than the one they came from. In that case they might a have a onward ticket to someplace.

Some people choose to ignore the law, there are consequences but it's hardly the end of the world.

 

He will get out and be on his merry way once the fine has been paid and that will be the end of it, no big deal really.

I quite agree, ukrules.
There are currently young boys who are in a terrible situation, as they leave for a beautiful expedition, happy and carefree like all children in the world.
Them they had not chosen this nightmare.
So, for the unconscious !!!!

They are automatically deleted if they on the list of prohibited words. Most of them are on Google's list of prohibited words that Thai Visa has to comply with.
