Man wanted for rape of girl, 14, six years ago arrested in Bangkok

A wanted man has been arrested in Bangkok for allegedly raping a minor girl in Khon Kaen province six years ago.

 

Region 5 Crime Suppression Division on Monday arrested Trakul (last name withheld), aged 28 years, at a residence on Chalerm Prakiat Road in Bangkok’s Prawet district.

 

Trakul, who worked as a security guard for a housing project in Nong Bon subdistrict, had an arrest warrant issued by Khon Kaen Provincial Court dated December 8, 2014 for rape of a person less than 15 years old who is not their spouse, as well as for taking a minor from their parents.

 

Officials said that they had tracking the suspect from Khon Kaen province since 2014 and found out recently that he had fled to Bangkok and was working as a security guard.

 

“Trakul had been in a relationship with a 14-year-old girl in Khon Kaen, but they had broken up. On August 18, 2014, the suspect called the girl to his house to discuss getting back together, but ended up raping her instead,” said the police. “The victim informed her parents and filed a complaint at Nong Rua Police Station in Khon Kaen.”

 

Trakul reportedly confessed to his crime on being arrested, after which he was brought to the police station for the legal process.

Can someone have a 14 year old spouse over here?

 

WHAT IS THE MINIMUM LEGAL FRAMEWORK AROUND MARRIAGE?

Under the Civil and Commercial Code of Thailand 1985 the minimum legal age of marriage is 20 years. However individuals are able to marry at 17 years or even before that with permission of the Court.

The good news is that Thai rapists get arrested, in due course, when the time's right.. The bad news is that it seems that one may rape one's spouse.

 

I thought that rape was rape and that it was totally aggravated when it involved a child.

 

The other bad news here is that the rapist managed to hide in Bangkok for 6 years, which is only possible if the family covers up. So, more than one arrest would be needed.

If the families agree they can cohabit as a common law couple. Happened with a 14 year old in my village. The marriage only lasted a month as she wiped herself out on a motorbike.

You can get married at age 13 with the courts permission.

There's even a get out clause in Thai law that specifies all charges for sex with a 13-15 year old will be dropped if you subsequently marry.

Years ago my wife ( ex wife) now wanted us to go to her friends for a wedding , I found out that her friends brother (30 ) was marrying a 13 year old girl , needless to say ,we never went , paedo should go to jail for that

But until recently most western countries considered the wedding contract binding, so spousal rape was impossible as you had both given irrevocable consent for the duration of the marriage. In 1997 the UK changed the law to invalidate all existing and subsequent traditional wedding vows and suddenly you could rape your wife.

 

Back on topic,

In Thailand charges of rape and underage sex may be nothing more than an attempt to force marriage, or extract money. Nothing here is what it appears to be on the surface. In the OP the police took 6 years to catch the guy, but they probably weren't looking as they considered the offence as serious as driving a m/c without a licence.

 

While we western folk are thinking 'hang him high', she and/or her parents may be thinking 'wedding bells'.

Wedding Bells? more like Money.

Village marriage, which is often unregistered; presumably the law is written to take cares for old traditions, still in use.
