Judge Chuktan warns Trump against 'inflammatory' remarks before trial

A federal judge has warned former US President Donald Trump against making "inflammatory" statements which could taint the jury pool ahead of his trial for conspiring to overturn the result of the 2020 election.

But Judge Tanya Chuktan ruled that Mr Trump can publicly share some of the non-sensitive evidence which prosecutors disclose to his legal team.

Friday's ruling was a blow to the special counsel who had expressed concern Mr Trump might reveal secret material and intimidate witnesses.

At a 90-minute hearing in Washington DC, the judge said the historic case was proceeding as normal.

"He is a criminal defendant. He is going to have restrictions like every single other defendant," she said.

"The fact that the defendant is engaged in a political campaign is not going to allow him any greater or lesser latitude than any defendant in a criminal case."

 

What Mr Trump can reveal publicly is one of several battles being fought between the former president's legal team and federal prosecutors.

What is a protective order?

Requests for protective orders are fairly routine in criminal cases. In many cases, defence teams are reluctant to oppose the orders because doing so would slow down "discovery" - the process in which prosecutors hand over evidence.

In this case, however, Mr Trump and his lawyers argued that his free speech was being stifled and argued that only sensitive information should be kept under wraps.

Judge Chutkan agreed. However, she said that his First Amendment rights was "not absolute" amid the ongoing case - and warned that she would not allow a "carnival atmosphere" at his eventual trial.

If you or I had behaved like 45, you bet your bottom dollar we'd be in the gray bar hotel. His is a different situation. IF she threw him in the hoosegow, he'd become the greatest martyr since what's-his-name, that guy they nailed to a cross. From what I've seen, the judge is doing a wonderful balancing act.

Judge Chutkan also referred to his campaign as a "day job" and told him if he didn't behave himself, she'd just move the court date up that much sooner, the thing he is most afraid of!

It has been pointed out several times on this forum already: Trump is being treated with kid gloves. I understand your point, although I disagree.  No intimidation, the court wants to silence the defendant & still call it a public hearing, and that's not politically motivated?  I don't believe there was any violent intent behind his remarks, although most of the media would have you believe this narrative.  

I retract the nutter comment & apologize if you're offended, nothing personal. However, I've noticed a prevailing trend of comments on this forum that exhibit a noticeable left-leaning bias and occasionally convey a tone of animosity & hate, which can detract from productive discourse.
Idolization? Not at all, I'm just another putter willing to throw my opinions out there, and those left-leaning perspectives might just want to suppress that.

Characterizing the content as 'stating the truth' from left media sources is delusional, as expected.  If you bothered to pay attention and invest time in observing unedited senate hearings (incl. witness testimonies) & house floor debates rather than relying solely on heavily edited media, you might gain insight not readily available through those sources, and possibly question your so called 'truths'.

Certainly not politically motivated.

  trump is out on bail, and as such he is governed by those bail limitations, no different than any other defendant on bail regardless of their political orientation.

  What trump is doing is trying to poison the well, and then claim that the well is poisoned and we need a new well. 

Judge Chuktanis is no  Aileen Cannon (assigned 1,810 cases and issued opinions in 616   ) , She will have none of that. 

  Cannon .(  assigned 224 criminal cases — only four of which went to trial,  ) on one of these four she forgot to swear in the jury pool, In another he closed the jury selection to the public violating the defendants 6th amendment rights.

You were right, but the playing field has just been upset. The good news is that two Federalist Society, Right-wing judicial scholars join together and write a 126 page article citing in great detail why the 14th Amendment to the US Constitution is self evident to apply, that Donald Trump is DISQUALIFIED to hold ANY OFFICE in the USA. Those on the political left have said since the insurrection in 2021., But this time it is coming in a way that will prompt and win suits in many states - to remove his name from any ballots.

Well if Judge Chuktan decides that Trump has violated terms of his bail release orderand revokes bail, I guess she can send out a US Marshall squad to find him and return DJT to the Judge's venue.
