The context of the "bad guys out" statement was that overstayers were defined as the "bad guys".

 

As long as he is all visa'd up he remains a "good guy".

If he's on a tourist visa he will be classed a tourist.

I came to the same conclusion. I was also wondering why he would spit on and try to slap, the wife, who was a passenger.
