The President does not get to decide what is the law. As Justice Roberts points out, the appellate process is the means to challenge court orders. 
 

Ignoring a court order or unilaterally deciding its scope is a breach of the separation of powers.

I highlighted the portion you somehow don't understand: "predatory incursion is perpetrated, attempted, or threatened against the territory of the United States by any foreign nation or government…." Do you understand what "foreign nation" means? "foreign government". Any predatory incursion is done by private individuals, not governments. And there is no declared war.
